Povzetek
Republika Hrvaška je unitarna, nedeljiva, demokratična in socialna država. Državna oblast je utemeljena na načelu delitve oblasti na zakonodajno, izvršilno in sodno ter je omejena s pravico do lokalne in regionalne samouprave. Lokalna samouprava je organizirana na dveh ravneh. Prvo raven predstavlja 429 občin in 126 mest (lokalna samouprava v ožjem pomenu), drugo raven (regionalno) pa 20 županij in Mesto Zagreb, ki ima poseben položaj županije in mesta. Enote lokalne in regionalne samouprave imajo pravico do medsebojnega sodelovanja in združevanja ter pravico do sodelovanja z lokalnimi enotami drugih držav. Pravica do lokalne in regionalne samouprave se uresničuje preko lokalnih in regionalnih predstavniških in izvršilnih organov izvoljenih na svobodnih volitvah, prebivalcem pa je omogočeno tudi neposredno sodelovanje pri opravljanju lokalnih nalog skozi referendume, zbore in druge oblike neposrednega odločanja. Enote lokalne samouprave opravljajo naloge iz lokalnega delokroga s katerimi se neposredno uresničujejo potrebe prebivalcev, enote regionalne samouprave pa opravljajo naloge regionalnega značaja. V skladu z načelom subsidiarnosti imajo pri dodeljevanju nalog prednost tiste enote, ki so najbližje prebivalcem. Osrednja državna oblast ne sme posegati v tisto, kar je v pristojnosti lokalnih in regionalnih oblasti. Enote lokalne in regionalne samouprave imajo pravico do lastnih prihodkov, država pa je dolžna pomagati finančno šibkejšim enotam lokalne samouprave ter financirati opravljanje prenesenih nalog.

Republic of Croatia is a unitary, indivisible, democratic and social country. State authority is founded on the principle of division of power into legislative, executive and judicial and is limited by the right to local and regional self-government. Local self-government is organized on two levels. On first level there are 429 municipalities and 126 cities (local self-government in narrower sense), and on the second level (regional) there are 20 counties (called ‘županije’) and the city of Zagreb, that has a special position as county and city. Units of local and regional self-government have the right to mutual cooperation and merging, and also the right to cooperate with local units of other countries. The right to have local and regional self-government is realizable through local and regional representative and executive organs, chosen in free elections, while the citizens are entitled to take an active part in fulfilling regional duties through referendums, meetings and other instances of direct decision making. Units of local self-government perform duties from local range of activities that realize citizen needs directly, while units of regional self-government perform duties of regional character. In accordance with the principle of subsidiary, units that are closest to the citizens, have advantage when tasks are assigned. Central state government is not allowed to interfere with anything that falls within the competence of local and regional self-government. Units of local and regional self-government have the right to have their own income, while the state is obligated to help units of local self-government that are financially weaker and to finance tasks that are transferred to them. |
