Povzetek
Predkazenski postopek je skupek procesnih dejanj, ki so izvedena z namenom odkritja kaznivega dejanja in izsleditvijo storilca. S hišno preiskavo, ogledom kraja dejanja, osebno preiskavo, odreditvijo izvedenstva ter z zaslišanjem osumljenca se zberejo in zavarujejo dokazi, ki so pomembni za potek celotnega kazenskega postopka. V predkazenskem postopku ima pomembno vlogo državni tožilec, ki po prejetju kazenske ovadbe preuči njeno vsebino in se odloči za eno izmed zakonskih možnosti. V primeru, da obstaja utemeljen sum, da je določena oseba storila kaznivo dejanje, državni tožilec vloži zahtevo za preiskavo. Kazenski postopek je razdeljen na več stadijev. Kazenski postopek zoper storilca nasilja nad otroki ima več posebnosti. Zakon otroku določa položaj privilegirane priče na sodišču, če je obdolženčev krvni sorodnik v ravni ali stranski vrsti do vštetega tretjega kolena ali če je obdolženčev posvojenec. Prav tako se otroka ne sme zaslišati, kadar zaradi svoje duševne razvitosti ne more razumeti pravice, da mu ni treba pričati, razen če to obdolženec sam zahteva. Nedopustno je neposredno zaslišanje oseb, mlajših od petnajst let, ki so bile žrtve kaznivih dejanj zoper spolno nedotakljivost, kaznivega dejanja zanemarjanja otroka in surovega ravnanja ter kaznivega dejanja trgovine z ljudmi. Otrok mora po zakonu imeti pooblaščenca, kadar gre za kazniva dejanja zoper spolno nedotakljivost, kaznivo dejanje zanemarjanja otroka in surovo ravnanje z njim ter kaznivo dejanje trgovine z ljudmi. Pooblaščenec ves čas od uvedbe kazenskega postopka dalje skrbi za njegove pravice. Naš kazenski sistem izbira med široko možnostjo uporabe kazenskih sankcij za polnoletne storilce. Tako ločimo kazni, opozorilne sankcije, varnostne ukrepe in alternativne sankcije.

The prepenal proceedings are a unit of activities implemented with the intention to find out the penal act and to trace out the perpetrator. On the basis of the house search, inspection of on-the-spot penal act, personal search, proficiency decree and suspect interrogation the evidences having the material meaning for the whole penal proceedings are collected and protected. During the prepenal proceedings the attorney general plays the essential role due to the fact that after the receipt of penal denuncement he studies its contents and decides on specific legal act. In case there is a grounded suspicion that the person in question did a penal act the attorney general file an application for investigation. The complete penal proceedings are divided into several stages. The penal proceedings against a person who commits a child abuse act has several particularities. The law determines a privileged position for the child as a witness at the court of justice in case the child is the blood relative including the third generation or the child is the adoptee of the accused.
In addition a child should not be interrogated when because of his mental development could not understand the right that he does not have to witness unless the accused requires the above stated. The direct interrogation of the person under the age of 15 who is a victim of penal act regarding sexual untouchability, child neglect or maltreat and white-slave trade. According to the law the child has to have the deputy attorney in all and any the above mentioned cases. During the complete period of penal proceedings the deputy attorney shall take care for the child rights. Our penal system allows to impose various criminal-law sanctions for adult perpetrators. Consequently, we differ various sentences, warning sanctions, safety measures and alternative sanctions. |
