Povzetek

V diplomski nalogi smo podrobno razčlenili učinke notarskega zapisa, ki je najpomembnejša notarska listina, ki jo sestavljajo notarji. V prvem delu diplomske naloge so opisane notarske listine, s čimer smo želeli poudariti njihove razlike v pravnem učinkovanju in opozoriti na pomembnost notarskega zapisa prav zaradi pravnih učinkov, ki jih ima. Vse notarske listine so javne listine, vendar ima notarski zapis še vrsto drugih pravnih učinkov, ki strankam zagotavljajo pravno varnost - na primer učinek veljavnosti pravnega posla, ki je sestavljen v notarskem zapisu, in seznanitev strank s pravnimi posledicami pravnega posla s strani notarja - za razliko od ostalih notarskih listin, notar tudi odgovarja za vsebino listine, ki je sestavljena v notarskem zapisu. Zakon o Notariatu vsebuje vrsto določb in pravil, ki zagotavljajo, da bo notar svoj poklic opravljal strokovno, vestno, pošteno in nepristransko. V tretjem in četrtem delu diplomskega dela smo želeli poudariti kako že sama stroga obličnost, način sestavljanja in vsebina notarskega zapisa, kakor jih določa ZN, varuje stranke pravnega posla z namenom zagotoviti pomembne pravne učinke, ki jih ima notarski zapis. Za določene pravne posle je že na podlagi različnih zakonov, zaradi varovanja javnega interesa, predpisano, da morajo biti sestavljeni v obliki notarskega zapisa. Obličnost je predpisana zaradi dokazovanja pravnega posla in je tudi pogoj za njegovo veljavnost. Vendar pa se veliko pravnih poslov, za katere ni z zakonom predpisana obličnost notarskega zapisa, sklepa v tej obliki prav zaradi učinkov, ki jih ima notarski zapis. Določbe ZN o načinu sestavljanja in vsebini notarskega zapisa zagotavljajo, da ima notarski zapis učinke, ki smo jih podrobneje obrazložili v nadaljevanju diplomske naloge. V petem delu diplomskega dela smo podrobneje razčlenili pravne učinke, ki jih ima notarski zapis. Osredotočili smo se zlasti na najpomembnejša, in sicer na dokazni učinek notarskega zapisa kot javne listine in neposredno izvršljivost notarskega zapisa. V 20 letih delovanja notariata so Vrhovno sodišče Republike Slovenije in višja sodišča v zvezi z notarskim zapisom kot javno listino in z izvršljivostjo notarskega zapisa zavzela zanimivo sodno prakso, ki smo jo v diplomsko nalogo vključili pri posameznih poglavjih. V zadnjem delu diplomske naloge je opisan pomen notarskega zapisa v mednarodnem pravnem prometu, pri čemer je najpomembnejše, da notarski zapis učinkuje v tujem pravnem okolju brez zapletenih in dolgotrajnih postopkov legalizacije.

Sekundarni povzetek: The following thesis takes a detailed look into the effects of notarial deeds, which are the most important documents written by notaries. In the first part of the thesis various notarial documents are described in order to accentuate the differences in their legal effect and draw attention to the importance of the notarial deed and its legal effects. All notarial documents are public documents, but the notarial deed has a number of other legal effects that guarantee legal certainty for the clients; e.g. the effect of validity of a transaction recorded in the notarial deed, and the obligation of notaries to familiarize their clients with legal consequences of transactions. In contrast with other forms of notarial documents, the notary is solely responsible for the content of the document, drawn up in a notarial deed. The Notary Act contains a number of provisions and rules that ensure that notaries perform their profession professionally, diligently, fairly and impartially. In the third and fourth part of the thesis we wanted to highlight how the strict formality itself, concerning the drawing-up and the contents of a notarial deed, specified in the Notary Act, protects the clients involved in a legal transaction in order to ensure the important legal effects inherent in the notarial deed. Various laws concerning protection of the public interest already require that certain legal transactions be prepared in the form of a notarial deed. Formality is required in order to prove the transaction and is also a condition for its validity. However many transactions for which there is no statutory regulation concerning their formality, are prepared in the form of a notarial deed, on account of the legal effects of this form. The provisions of the Notary Act dealing with the method of compiling the notarial deed and its content ensure the effects of the notarial deed, which we further explain in detail in the following parts of the thesis. In the fifth part of the thesis we have analysed in detail the legal effects of notarial deeds. We focused in particular on the two most important effects, i.e. the probative value of a notarial deed as public document, and the direct enforceability of a notarial deed. In 20 years of activity of Notary Services the Supreme Court of the Republic of Slovenia and the higher courts have assumed an interesting case-law regarding notarial deeds as public documents, and enforceability of notarial deeds; this case-law is discussed in individual chapters of the thesis. In the final part of the thesis we describe the significance of notarial deeds in international legal transactions; in these transactions it is of greatest importance that notarial deeds can take effect in foreign legal environments without complicated and lengthy procedures of legalisation.
