Povzetek

V diplomskem delu je obravnavano varstvo delavcev pred upokojitvijo v povezavi z odpovedjo pogodbe o zaposlitvi, ki delavce pred upokojitvijo ščiti, da jim delodajalec brez njihovega pisnega soglasja praviloma ne more odpovedati pogodbe o zaposlitvi. Slovenska zakonodaja varuje delavce pred upokojitvijo (pa tudi nekatere druge kategorije delavcev) le pred odpovedjo pogodbe o zaposlitvi iz poslovnega razloga, ne pa tudi iz drugih razlogov, kot je recimo krivdni razlog ali razlog nesposobnosti. V diplomskem delu je predstavljena primerjava med sedanjo in predhodno ureditvijo področja varstva starejših delavcev oziroma delavcev pred upokojitvijo v primeru odpovedi pogodbe o zaposlitvi. Predstavljena je tudi sodna praksa, ki se nanaša na to področje. Ker se Republika Slovenija v zadnjih letih sooča s precejšnjim številom odpuščanj delavcev, je bila v okviru diplomskega dela opravljena raziskava, v kateri smo delodajalce in vodjo bančne pravne službe spraševali, kako dobro poznajo zakonodajo s področja varstva delavcev pred upokojitvijo.

Sekundarni povzetek: The graduate thesis examines the protection of workers awaiting retirement, as it relates to the termination of the employment contract which shields workers who are soon to retire, by making sure an employer cannot terminate their contract without an express written consent. When referencing the protection of workers before retirement, we have to make it clear that when it comes to certain categories of workers, the law only protects them from having their employment contracts terminated due to business reasons; they are, however, not protected from being terminated on fault-based grounds or due to incompetence. The graduate thesis presents a comparison between the current and past method of protecting older workers or workers before retirement in the event of employment contract termination. The case law in these instances is also reviewed. In the last couple of years, Slovenia has been faced with a significant number of layoffs. Consequently, we also carried out a survey, asking employers and the head of a bank’s legal office about just how well they know the relevant legislation pertaining to the protection of workers before retirement.
