Povzetek

V diplomskem delu je obravnavana pravica pacienta do samoodločanja s poudarkom na vnaprej izraženi volji. V preteklosti med zdravnikom in pacientom ni bilo prave komunikacije, pacient je v tem odnosu imel vlogo pasivnega udeleženca. Bil objekt zdravljenja, zdravnik pa vsemogočni bog v beli halji, ki je zanemarjal voljo in želje pacienta. Glavno vodilo pri medicinskih posegih in zdravstveni oskrbi je bilo načelo zdravje je najvišji zakon (salus aegroti suprema lex), ki ga je danes zamenjalo načelo pacientova volja je najvišji zakon (voluntas aegroti suprema lex). Pravica pacienta do samoodločanja vključuje pravico do obveščenosti in sodelovanja, pravico do samostojnega odločanja o zdravljenju in pravico do upoštevanja vnaprej izražene volje. Predpogoj, da se pacient lahko pravilno odloči, je zdravnikova obveznost, da opravi pojasnilno dolžnost. Na podlagi pridobljenih informacij, se pacient lahko odloči ali bo v medicinski poseg oziroma zdravstveno oskrbo privolil, ali pa jo bo zavrnil. Pacient lahko izrazi tudi vnaprejšnjo izjavo volje za primere, ko ne bo sposoben odločanja o sebi. Za veljavnost vnaprej izražene volje morajo biti kumulativno izpolnjeni strogi zakonski pogoji. V grobem je predstavljena tudi nemška in avstrijska pravna ureditev vnaprej izražene volje. V povezavi z obravnavano temo se pojavljajo aktualne razprave, ki se tičejo evtanazije ter Jehovovih prič in transfuzije krvi, o čemer je govora na koncu diplomskega dela.

Sekundarni povzetek: This thesis discusses patient's right to self-determination with emphasis on the advance decision to refuse treatment. In the past, there was no real communication between the doctor and the patient, the patient in this relationship was a passive participant. The patient was the object of medical treatment and the doctor was an almighty god in white cloak, who neglected patient's will and wishes. The major principle of medical treatment and nursing care was health as a supreme law (aegroti salus suprema lex), which today changed into the principle that the patient's will is the supreme law (voluntas suprema lex aegroti). Patient's right to self-determination includes the right to inform and participate, the right to autonomous decision-making about patient's treatment and the right to respect anticipated will. Condition of patient's right decision is the doctor's duty to explain and inform about patient's consent. On the acquired informations the patient will be able to make decision, if he will be in the medical treatment or nursing care consent, or if he will refuse it. The patient can also form an anticipated will in case, when the patient is not able to make it's own decisions. For the validity of the anticipated will there must be a fulfiled cumulate with all act prescribed strict conditions. There is also presented the German and Austrian law regulation of anticipated will. In connection with discussed topic there also appear current debates which relate to euthanasia and Jehovah's Witnesses and blood transfusion, which is described at the end of this thesis.
