Povzetek

Osebe z duševnimi motnjami so ranljiva skupina, saj zaradi vpliva duševnih motenj na njihovo mišljenje, zaznavanje, razsodnost, obnašanje, odločanje, ipd. niso sposobni sprejemati odločitev, kaj je v njihovem interesu in varovati svojih pravic. Te osebe so zaradi duševnih motenj stigmatizirane in diskriminirane, kar vpliva na kršenje njihovih pravic. Zato mednarodni in nacionalni pravni akti določajo pravice, ki jim pripadajo in njihovo varstvo. Še posebej so varovane pravice oseb z duševnimi motnjami v postopku zdravljenja brez privolitve, ki posega v pravico do prostovoljnega zdravljenja in pravico do osebne svobode. Zdravljenje brez privolitve mora imeti podlago v ustavi, zakon mora določiti natančne pogoje, odredi se s sodno odločbo in zagotovljena morata biti sodni nadzor in sodno varstvo. Zakon o duševnem zdravju je celovito določil pravice oseb z duševnimi motnjami ter njihovo varstvo, največ pozornosti pa je posvečene postopkom zdravljenja oziroma obravnave brez privolitve.

Sekundarni povzetek: People with mental disorders are a vulnerable group and because of the influence of mental disorders on their thinking, perception, reason, behavior, decision-making, etc. they are not capable of making a decision, what is in their interest and to protect their rights. These people are stigmatized and discriminated because of mental disorders, which affects the violation of their rights. Therefore, international and national legal acts regulate the rights of people with mental disorders and their protection. In particular, they protect the rights of persons with mental disorders in the process of medical treatment without consent, which interferes with the right to voluntary treatment and the right to personal liberty. Treatment without consent should be based in the Constitution, the law must determine the exact conditions, it is ordered by a court decision and must be provided by judicial review and protection. Mental Health Act entirely determines the rights of persons with mental disorders and their protection, most attention has been focused on the procedure of medical treatment or treatment without consent.
