Povzetek

Starši so zakoniti zastopniki svojega mladoletnega otroka, ki še nima popolne poslovne sposobnosti. Svojega otroka zastopajo pred sodišči ter pred drugimi organi in organizacijami in sklepajo pravne posle v njegovem imenu in za njegov račun, ter tako skrbijo za osebo in za premoženje otroka. V moderni družbi in z modernim načinom življenja vse pogosteje prihaja do položaja, ko starši in otroci niso isti državljani ali ne prebivajo v isti državi članici EU. Ta socialni problem postane relevanten predvsem v primerih, ko pride med samimi starši ali med starši in otroki do sporov v zvezi z izvrševanjem starševske odgovornosti, v obseg katere spada tudi vprašanje pravice do zastopanja otroka. V teh primerih postane najprej pomembno vprašanje, v kateri državi članici je mednarodno pristojno sodišče za razrešitev spora. Uredba Sveta (ES) št. 2201/2003 z dne 27. novembra 2003 o pristojnosti in priznavanju ter izvrševanju sodnih odločb v zakonskih sporih in sporih v zvezi s starševsko odgovornostjo ter o razveljavitvi Uredbe (ES) št. 1347/2000, t. i. Bruseljska uredba IIa, ureja način določanja mednarodno pristojnega sodišča za razrešitev spora, ki se je pojavil v primeru mednarodnih družin ter postopek priznavanja in izvrševanja tujih sodnih odločb. Uredba ima prednost pred nacionalno zakonodajo. Pojavi pa se tudi vprašanje, katero pravo bo pristojno sodišče uporabilo za razrešitev spora, kar pa se rešuje po nacionalnem pravu držav članic, kajti Bruseljska uredba IIa na področje uporabe prava ne posega.

Sekundarni povzetek: Parents are the legal guardians of their minors, who did not yet acquire full legal capacity. Thus, parents represent their children before the courts, other bodies and organisations and conclude legal transactions on their behalf and to their account with the aim to preserve the person and the property of the child. In the modern society and according to the modern way of life there are often situations when the parents and children are not citizens of the same state, nor do parents reside in the same EU member state. However, this social problem becomes particularly relevant in the event of disputes between the parents themselves, or between the parents and children regarding the implementation of parental responsibilities, including the right to representation of a child. In such cases we usually face the question: in which country is the internationally competent court for resolution of the dispute. The Council (EC) Regulation no. 2201/2003 of 27 November 2003 concerning jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility, repealing Regulation (EC) No. 1347/2000 (i.e. the Brussels Regulation IIa) regulates the manner for determination of internationally competent court for the resolution of a dispute which occurred in the case of international families, as well as the procedure for the recognition and enforcement of foreign judicial decisions. The Regulation takes precedence over the national law. The law to be applied by the court for resolution of the dispute is determined according to national law of member states. The Brussels Regulation IIa is without prejudice to the scope of law.
