Povzetek

Samozaposleni so osebe, opredeljene v Zakonu o invalidskem in pokojninskem zavarovanju (ZPIZ-1), ki kot svoj edini in glavni poklic v Republiki Sloveniji opravljajo samostojno dejavnost in z njo ustvarjajo dohodek, ki dosega vsaj minimalno plačo. Samozaposleni so samostojni pri organiziranju poslovanja, samostojno določajo organizacijo dela, odločajo o gospodarjenju in finančnih vprašanjih. Socialna varnost samozaposlenih se od ostalih oseb razlikuje, zato bom predstavila njihove prednosti in slabosti. Njihove pravice in obveznosti glede plačevanja socialnih prispevkov, stopnje socialnih prispevkov, obveznost zavarovanja ter možni razlogi prenehanja obveznega zavarovanja. Kot v Sloveniji je samozaposlovanje zaželeno tudi v Evropi, opredelitev delavca v evropskem pravu in njegove pravice. Kadar pa samozaposleni ne ustvari zadostnih sredstev za preživetje ali zaradi stečaja njegovega podjetja — dejavnosti preneha delati, se sooča s problemom brezposelnosti, kjer uveljavlja zavarovanja za brezposelnost. Sledi še pregled pokojninske zakonodaje, ter prihajajoče spremembe, ki jih je v kratkem intervjuju predstavil generalni direktor ZPIZa Marijan Papež.

Sekundarni povzetek: Self-employed people are in the law about the disabled and pension insurance defined as people, who as their only and main profession in the Republic of Slovenia do an independent activity and with which they create and income that at least reaches a minimum wage. Self-employees are independent at business organisation, they set an independent organisation of work, they decide about managing and financial questions. Social security for self-employees distinguishes itself from the security for other people, so that is why I am going to represent their advantages and weaknesses, their rights and obligations about paying social contributions, levels of social contributions, security obligations and possible reasons of ending their security obligations. Like in Slovenia, self-employment is also desirable in Europe, definition of a worker in European law and his rights. But when self-employee does not create enough means for survival or stops working because of bankruptcy of his company – activity, he faces a problem of unemployment, where he puts into force the security for unemployment. Then a check of pension legislation follows, and the forthcoming changes, which were represented by the general director of ZPIZ Marijan Papež.
