Povzetek

Diplomsko delo z naslovom 'Pacientove pravice ex ante po Direktivi 2011/24/EU o uveljavljanju pravic pacientov pri čezmejnem zdravstvenem varstvu' seznanja z novim obsegom in vsebino pravic pacientov držav članic Evropske unije, ki jih v zdravstvenih sistemih držav članic uvaja nedolgo sprejeta Direktiva 2011/24/EU. Direktiva, ki je komaj začela veljati, in rok za implementacijo katere se bo iztekel 25.10.2013, predstavlja prvo pravo dejanje zakonodajalca Evropske unije za poenotenje zdravstvenega varstva v državah članicah. Ugotovljeno je bilo, da se znotraj Evropske unije zdravstveni sistemi držav članic preveč razlikujejo in da prihaja zaradi tega do neenakopravnosti pravic pacientov iz različnih držav članic, zato se zdi sprejem navedene direktive nujen in ustrezen. Temelj diplomskega dela predstavljajo vsebinske določbe direktive, ki paciente in njihove pravice zadevajo neposredno. Osredotočenost dela je zgolj na pomenu sprejema Direktive 2011/24/EU za slovenski zdravstveni sistem, pri tem pa je prikazana primerjava veljavne ureditve z anticipirano ureditvijo slovenske zakonodaje s področja zdravstvenega varstva, ki bo sprejeta v okviru implementacije Direktive 2011/24/EU. Podana je tudi kritična opredelitev ustreznosti določb sprejete direktive. Za dve pravici pacientov, ki v slovenskem zdravstvenem sistemu spadata med najbolj sporne, to sta pravica do spoštovanja pacientovega časa in s tem v zvezi problematika čakalnih dob, ter pravica do drugega mnenja, pa je konkretneje predstavljena ureditev, ki jo je mogoče pričakovati kot posledico sprejema zadevne direktive.

Sekundarni povzetek:	The dissertation with title 'Patient's rights ex ante under the Directive 2011/24/EU on the application of patient's rights in cross-border healthcare' introduces the new scope and content of patient's rights from member states of European Union, which will be initiated in the health systems of member states by recently adopted Directive 2011/24/EU. The directive just came into force and it's time limit for the implementation will expire at 25th of October 2013. It represents first real action of European Union legislator for homogenizing cross-border healthcare of member states. It has been discovered that there is too profound differentiation within health systems of member states of European Union, and this consecutively causes inequality of rights of patients that come from different member states. Therefore the adoption of above mentioned directive seems necessary and adequate. The basis of dissertation comprises content provisions of the directive that directly concern patients and their rights. The main focus of dissertation is on meaning of adoption of the Directive 2011/24/EU for the Slovenian health system. There is presented the comparison of the currently valid health legislation with anticipated Slovenian health legislation that will be adopted in the framework of implementation of the Directive 2011/24/EU. There is also set out critical view of suitability of adopted directive’s provisions. There is made concrete presentation of the settlement that is to be expected as a consequence of the adopted directive about the two of the most controversial rights of patients in Slovenian health-care system. These are the right to respect for patients time (and in the connection to this right the problem of waiting periods) and the problem of the right to a second opinion.
