Povzetek
Tako kot v drugih državah smo bili tudi v samostojni Republiki Sloveniji priča številnim stavkam, v zvezi s katerimi se je večkrat sprožil spor o zakonitosti le teh.
V diplomski nalogi ugotovimo kako in s katerimi predpisi je urejena pravica do stavke v naši pravni ureditvi v primerjavi z mednarodno pravno ureditvijo, v kateri so nepogrešljiva stališča nadzornih teles nekaterih mednarodnih organizacij. Na podlagi pravne opredelitve stavke oziroma pravice do stavke je izpostavljeno vprašanje zakonite stavke v našem pravnem sistemu.
Vprašanje zakonitosti stavke je na prvem mestu obravnavano iz ureditve v Ustavi RS, izhodišče obravnavane problematike pa predstavlja predvsem Zakon o stavki ter drugi zakonski predpisi in kolektivne pogodbe. Ob upoštevanju navedenih predpisov in sodne prakse se razkrije cilj diplomske naloge, ki je bil ugotoviti katere predpostavke oziroma kateri pogoji morajo biti izpolnjeni za zakonito stavko, način reševanja spora o zakonitosti stavke ter kakšne pravne posledice nastopijo v primeru nezakonite stavke. Pri tem pa so izpostavljene tudi omejitve, ki se v zvezi s pravico do stavke nanašajo na določen krog subjektov.
Na koncu je prikazana primerjava problematike z nemško pravno ureditvijo in praktičen primer spora o zakonitosti stavke v Sloveniji.
Kljub ugotovitvi, da Zakon o stavki ne daje enovite pravne podlage za rešitev vseh vprašanj v zvezi s stavko, pa se izkaže, da je dovolj jasen ter ne predstavlja ovire in ne postavlja pretežkih zahtev za izvedbo zakonite stavke. Prav tako pa je vsaj v večini tudi v skladu z mednarodnimi pravnimi normami oziroma stališči.

In the independent Republic of Slovenia, similar to other countries, we have witnessed many strikes that have motivated disputes over its legality on many occasions.
This diploma thesis tries to find how and by which regulations our law regulates the right to a strike, in comparison to international regulation, where the positions of supervisory bodies of some international organisations are indispensable. Based on the legal classification of a strike or a right to strike, a question about its legality in our legal system is being raised.
The question about legality of a strike is first considered from the point of view of the Constitution of the Republic of Slovenia, however the platform of the issues addressed mostly represents the Strike Act and laws, and collective agreements. In the light of these regulations and judicial practice, the goal of this diploma thesis is revealed – the assumptions and conditions that must be fulfilled when making a legal strike, resolution method of the strike legality dispute, and what are the types of the consequences for when a strike is illegal. Limitations on the right to a strike relating to a specific group of entities are also included in this paper.
At the end there is also a comparison of issues on German legal regulations and a practical example of disputes over legality of a strike in Slovenia.
Despite establishing that the Strike Act does not give a uniform legal basis for solution of all questions considering the strike, the act is clear and does not represent an obstacle or heavy demands for implementing the legal strike. Also, it is mostly in accordance to the international rules of law and viewpoints. |
