Povzetek

V magistrski nalogi z naslovom Naloge policije pri preprečevanju in odkrivanju spolnega nasilja v družini, ki je nastala pod mentorstvom prof. dr. Andreja Anžiča, avtor Robert Ovčar obravnava vprašanja deliktov spolnega nasilja v družini ter spremljajočega družinskega nasilja in predstavlja analize in pristope pri reševanju tega splošnega problema. Pri tem obravnava aktualna vprašanja in v nalogi podaja argumente in odgovore o tem, ali organi, ki odločajo o prihodnosti žrtve kaznivega dejanja kakor tudi storilca, težijo k temu, da so nadaljnji dogodki oz. življenje po hudi izkušnji kaznivega dejanja obravnavani s pomočjo vseh vpletenih institucij in ali delujejo samo v svojem interesu ali v globalnem interesu pomagati samo po svojih močeh in ne s pomočjo vseh pristojnih institucij ter njihovih vzvodov. V nalogi avtor podaja pregled stanja na področju obravnavanja kaznivih dejanj med leti 2002 in 2014 ter statistični pregled po policijskih upravah in pregled letnih poročil državnih tožilcev. Navaja razloge, ki so Ministrstvo za pravosodje - predlagatelja novega Zakona o kazenskem postopku in Zakona o preprečevanju nasilja v družini - pripeljali do tega, da je pripravil spremembo zakonodaje na tem področju; navaja tudi, v kolikšnem obsegu se je zakonodaja spremenila. Novi Zakon o kazenskem postopku in Zakon o preprečevanju nasilja v družini sta bila potrebna zaradi uskladitve prava z našo ustavno ureditvijo, drugo zakonodajo, mednarodnimi dokumenti in obveznostmi naše države do mednarodne skupnosti. Novo sprejeta kazenska zakonodaja, to sta Zakon o kazenskem postopku in Kazenski zakonik, sta zahtevala uskladitev materialnih in procesnih institutov prava s to zakonodajo. Avtor je poskušal predstaviti različnost v delovanju naših represivnih organov in tujih institucij v nekaterih drugih državah članicah EU. Predstavi delo policije in v nekaterih poglavjih terensko delo policistov, ki neposredno zaznajo elemente kaznivega dejanja ter se prvi soočijo z žrtvami ter osumljencem. Poskuša opisati delo med vladnimi in nevladnimi institucijami ter, po njegovi oceni, obveščanje in sodelovanje med njimi uvršča na prvo mesto dela pri preprečevanju in odkrivanju kaznivih dejanj z elementi spolnega nasilja ter pomoč ljudem, ki se že znajdejo v krogu tega strokovne terapije potrebnega pojava.

Sekundarni povzetek: The master thesis titled The Role of the Police Authority in Preventing and Detecting Family Sexual Violence, written by Robert Ovčar, with the mentor Dr. Andrej Anžič, PhD, discusses sexual violence in a family and other cases of family violence, and presents the analyses and approaches in solving this general problem. It deals with the current questions on the topic and gives the arguments and answers to the question on whether the institutions tend to work together with other institutions or on their own with their own interests when they treat victims as well as those committing crimes of sexual violence. In the thesis the author gives an overview of criminal offences in the period from 2002 to 2014 and statistical review of the Police Directorates as well as the review of state prosecutor reports. It discusses the reasons that lead the Ministry of Justice, which is the proposer of the new Criminal Procedure Act and Family Violence Prevention Act, to change the legislation in this field and presents to what extent has it been changed. The New Criminal Procedure Act and The Family Violence Prevention Act were required in order to align the law with our constitutional situation, other legislation, international documents and the obligation of our country to the international community. The recently passed legislation, ie. The New Criminal Procedure Act and The Family Violence Prevention Act, required adjustment of material and process institutions of law with this legislation. The thesis presents also the difference in operation of our repression authorities and foreign institutions in some countries of the European Union. The tasks of the police authorities and also their field work is presented. The police authorities re the first to detect the criminal offence and face the victim and the suspect. The cooperation between the governmental and non-governmental institutions is described. According to the author, informing and cooperation is the most important part of preventing and detecting criminal offences with the elements of sexual violence and helping individuals that are involved in those crimes and need professional treatment
