Povzetek
S sklenitvijo zakonske zveze nastanejo za zakonca določene pravne posledice, tako na osebnem kakor tudi na premoženjskopravnem področju. Pravila družinskega prava na splošno, kot tudi premoženjskopravna razmerja med zakoncema, ureja Zakon o zakonski zvezi in družinskih razmerjih. Ta zakon pozna en sam, obligatoren zakonski režim. Je kogentne narave in zato zakonca ne moreta pogodbeno spreminjati premoženjskega režima, saj ta ni prepuščen svobodi pogodbenega urejanja.
Veljavna pravna ureditev določa režim skupnega premoženja in režim posebnega premoženja zakoncev. Trenutek, ko začnemo ločevati skupno in posebno premoženje zakoncev, je trenutek sklenitve zakonske zveze. Skupno premoženje zakoncev je tisto premoženje, ki ga zakonca pridobita z delom v času trajanja zakonske zveze. V zvezi s skupnim premoženjem velja zakonska domneva, da sta deleža zakoncev na skupnem premoženju enaka. Posebno premoženje zakoncev pa je premoženje, ki ga ima zakonec ob sklenitvi zakonske zveze, ostane njegova last in z njim samostojno razpolaga. V kategorijo posebnega premoženja uvrščamo prav tako premoženje, ki ga zakonca pridobita v času trajanja zakonske zveze, vendar ne z delom, temveč neodplačno.
Zakonskih določb, ki urejajo premoženjskopravna razmerja med zakoncema, je v slovenskem pravnem redu relativno malo. Velik pomen imajo na tem mestu sodišča, ki skozi svoje odločitve z interpretacijo in konkretizacijo zakonskih določb vsebino postavljajo v okvir prava.
Sprejetje novega Družinskega zakonika je na področju premoženjskopravnih razmerij med zakoncema prineslo velike spremembe. Zakoncem in zunajzakonskim partnerjem je omogočil, da bodo s sklenitvijo pogodbe o ureditvi premoženjskopravnih razmerij lahko izključili zakoniti premoženjski režim in tega uredili s pogodbo na način, ki jim najbolj ustreza. V primeru, ko zakonca ne bosta sklenila pogodbe o ureditvi premoženjskopravnih razmerij, bo za njiju veljal zakoniti premoženjski režim.

By concluding a marriage, certain legal consequences are created for the spouses, both in the personal and the property field. The rules of family law in general, as well as the property relations between spouses are governed by the Marriage and Family Relations Act. This Act knows a single, obligatory statutory regime. It is cogent by nature and therefore the spouses cannot contractually change the property regime, since the latter is not left to the freedom of contractual arrangement.
The current legal regime determines the joint property regime and the special property regime of the spouses. The moment when we start separating the joint and special property of the spouses is the moment of the conclusion of the marriage. The joint property of the spouses is the property that the spouses gain by working for the duration of the marriage. Concerning the joint property, there is a legal presumption that the shares of the spouses are the same. The special property of the spouses is the property which the spouse owns at the time of the conclusion of the marriage, which remains in their possession to dispose of independently. The property that the spouses acquire in the duration of the marriage, not by work, but free of charge, is also classified in the category of special property.
The number of legal provisions governing property relations between spouses is relatively low in the Slovenian legal order. Courts have a great importance in this field, which through their decisions with interpretation and objectification of legal provisions place the content in the framework of law.
The adoption of the new Family Code has brought about major changes in the sphere of property relations between spouses. It allows spouses and unmarried partners to exclude the legal property regime by concluding a contract on the regulation of property relations and to arrange it with the contract in a manner that best suits them. In the event that the spouses do not enter into a contract on the regulation of property relations, they will be subject to the lawful property regime. |
