Povzetek

Poslovna sposobnost spada med temeljne atribute fizičnih oseb, ki je povezana z vsemi področji posameznikovega življenja in na podlagi katere lahko oseba samostojno sklepa pravne posle, pridobiva pravice in se zavezuje. Veljavna slovenska zakonodaja še vedno predvideva možnost odvzema poslovne sposobnosti, ki radikalno posega v človekovo življenje. Poslovna sposobnost se lahko deloma ali popolnoma odvzame polnoletni osebi, ki zaradi duševne bolezni, duševne zaostalosti, odvisnosti od alkohola ali mamil ali iz drugega vzroka, ki vpliva na psihofizično stanje, ni sposobna skrbeti sama zase, za svoje pravice in koristi. Postopek se praviloma začne na predlog upravičenega predlagatelja ali po uradni dolžnosti sodišča. Kadar sodišče v izvedenem postopku ugotovi izpolnjenost pogojev za odvzem poslovne sposobnosti, izda sklep in ga pošlje pristojnemu Centru za socialno delo, ta pa osebo postavi pod skrbništvo in ji določi skrbnika. Oseba s popolno odvzeto poslovno sposobnostjo v pravnem prometu ne more več samostojno nastopati, medtem ko je oseba z delno odvzeto poslovno sposobnostjo postavljena v položaj mladoletnika med petnajstim in osemnajstim letom. Centru je v tem primeru omogočena določitev pravnih poslov, ki jih sme oseba z delno odvzeto poslovno sposobnostjo skleniti samostojno in brez odobritve skrbnika, vendar bi zaradi možnosti prekomernega posega v človekove pravice to moralo storiti že sodišče. Z odvzemom poslovne sposobnosti se globoko poseže v posameznikove osebnostne pravice, zato je v skladu z ureditvami modernih držav nujna odprava odvzema poslovne sposobnosti in prenova področja skrbništva za odrasle osebe. Prve spremembe se obetajo z začetkom veljavnosti Družinskega zakonika, vendar bi bila potrebna celovitejša reforma, na podlagi katere bi država osebam zagotavljala pomoč samo za tista življenjska področja oz. zadeve, kjer bi jo te dejansko potrebovale in ki bi se presojala glede na okoliščine vsakega posameznega primera.

Sekundarni povzetek: Legal capacity is a challenging and complex issue because it affects all areas of life, from choosing where to live and whether and whom to marry, to signing an employment contract, casting a vote or managing property. In the Slovenian legislation still exists the possibility of full or partial deprivation of legal capacity of an adult person with mental health problems, intellectual disabilities, drug or alcohol addiction. A center for social work or a public attorney as well as the spouse, another person who lives with the person, a relative or close family member can initiate the procedure. The affected person can also initiate the procedure if a court finds that he or she is able to understand its meaning and consequences. After the procedure the court delivers a single judgement, deciding that the person’s legal capacity is restricted and that he or she will be placed under a protective measure. Person with restricted legal capacity lose all or almost all of their civil rights and consequently needs guardians help. Decisions taken for a person under full guardianship need not consider the adult’s wishes and opinion. A serious deficiency is that the court does not determine the scope of partial deprivation of legal capacity and adult person is equalized with a minor aged 15-18 year. Center for social work has a possibility to determine the range of activities that a person can take without the consent of a guardian if deems it necessary. The Court is the one who should determine what a person cannot work or undertake, and in all other work areas a person should preserve full legal capacity. Deprivation of legal capacity is unacceptable in modern society and is contrary to the principles of respect for human rights and non-discrimination. Slovenia needs reform of legislation concerning the deprivation of legal capacity and extension of parental rights and the system of guardianship for adults, because existing solutions are not measures of support, but are measures that lead to denial the entire spectrum of rights and freedoms. Legal systems should ensure the existence of a large number of different measures for different people and different situations in which they can find, in order to provide some flexibility and individualization. Support measures should be determined only when it is absolutely necessary, and then measures must be proportionate to the degree of a person's ability and adapted to the individual circumstances and needs.
