Povzetek

Napotitev delavcev je pravni institut, oblikovan na ravni Evropske unije (EU) in Evropskega gospodarskega prostora (EGP) z namenom krepitve načela prostega pretoka storitev. Je razmerje, v katerem delodajalec iz domače države članice svojega zaposlenega napoti v drugo državo članico, da za časovno omejeno obdobje za naročnika v tej državi opravlja storitev. V zvezi z napotitvijo so v praksi države polarizirane na tiste, ki večinoma napotujejo, in tiste, ki večinoma sprejemajo delavce. Čeprav je namen napotitve približevati države članice EU oz. EGP prek integracije s krepitvijo notranjega trga, se prek nje kaže vrzel med njimi -tako socialno, ekonomsko kot politično. Ključna težava pri tem je iskanje primernega razmerja med ekonomsko in socialno perspektivo zakonodaje v praksi, ki ločuje udeležence, ki so na eni strani države članice z nižjim gospodarskim standardom ter podjetja, ki so podporniki ekonomskega vidika, na drugi strani pa države članice EU, ki so povečini starejše demokracije z višjo stopnjo varstva socialnih pravic, ter delavske organizacije, ki od evropskih zakonodajalcev zahtevajo sprejem jasnejših pogojev za zaščito napotenih in posledično domačih delavcev.Problematika je javnosti komaj vidna ali poznana, a dviguje veliko vprašanj, tudi bistvenih za razvoj Evropske unije v prihodnosti. Kako približati tako raznolike države, ne da bi se jim odvzel še dodaten del suverenosti? Kako najti primerno ravnovesje med dvema temeljnima, a neskladnima načeloma, kateri se obe štejeta kot gradnika Evropske unije? Kateri od strank v sporu naj se ugodi v večji meri? Napoteni delavci so v veliko primerih zlorabljani in izigrani -in tega se zgolj s spreminjanjem zakonodaje ne da preprečiti. Čeprav je pomembno, da je ta dobro zastavljena, je za primerno delovanje instituta nujno sodelovanje med državami, ki se morajo poenotiti glede interesov in načina delovanja.

Sekundarni povzetek: Posting of workers is a legal institute, formulated on the European Union and European Economic Area level with the purpose of enhancing the principle of free movement of services. It is a relationship in which employers send their employees from home state in another member state in order to perform a service for a contractor in this member state. Member states are in practice divided between those who predominantly post and those who primarily accept posted workers. Despite the purpose of posting being bringing member states of the EU/EEA closer together through integration with enhancing the internal market, it is instead showing the division between them, especially social, economical and political. The crucial problem with it is the search for the appropriate ratio between the economic and social perspective of the legislation in practice. This is creating a gap between the Member States with lower economic standards and businesses, which are supporters of the economic aspect on one hand, and the Member States which are mostly older democracies with higher degree of protection of social rights and workers' organisations, which demand from european legislators the adoption of clearer conditions to protect posted and consequently also domestic workers. Although the issue is hardly known to the public it raises many questions, including those essential for the future development of the European Union. How does one bring states which are so different from one another closer without increasingly depriving them of their sovereignty? Is there an appropriate balance between the two fundamental, but rather incompatible principles, which are both considered to be the building blocks of the European Union? Which of the parties in the dispute should be favoured to a greater extent? Posted workers are often exploited and swindled - in many cases that cannot be avoided nor prevented by merely changing legislation. Although it is important for legislation to be well constructed for the institute to function as intended, the unification of interests and practical cooperation between the states is of the essence.
