Delo policije in državnega tožilstva v predkazenskem postopku pri preiskovanju gospodarske kriminalitete

Povzetek

V diplomski nalogi smo predstavili gospodarsko kriminaliteto, policijo in državno tožilstvo ter njuno sodelovanje v predkazenskem postopku pri preiskovanju gospodarske kriminalitete. V Sloveniji imata pri odkrivanju in preiskovanju gospodarske kriminalitete v predkazenskem postopku pomembno vlogo policija in državno tožilstvo. Pri odkrivanju in preiskovanju gospodarske kriminalitete v predkazenskem postopku imajo v policiji pomembno nalogo lokalne kriminalistične skupine, Sektor za gospodarsko kriminaliteto in Nacionalni preiskovalni urad RS. Državno tožilstvo oziroma državni tožilec je vodja predkazenskega postopka, njegova vloga pa je usmerjanje policije, da zbere dovolj dokazov, da lahko po predkazenskem postopku uspešno nadaljuje kazenski pregon oziroma kazenski postopek. Empirični del diplomske naloge temelji na analizi s pomočjo spleta in podatkov državnega tožilstva. Za vzorec smo vzeli podatke iz letnih poročil policije in obravnavano gospodarsko kaznivo dejanje, ki ga je v predkazenskem postopku obravnavala Policijska postaja Slovenj Gradec. V nadaljevanju smo predstavili osumljeno podjetje Dural d.o.o. in zbrane dokaze policije v predkazenskem postopku, kjer smo teoretične ugotovitve policije v predkazenskem postopku primerjali še z ugotovitvami državnega tožilstva v nadaljnjem kazenskem postopku. Skozi analizo smo ugotovili, da policija uspešno preiskuje gospodarska kazniva dejanja, da je gospodarska kriminaliteta med leti 2008-2014 naraščala, nato pa pričela padati. S pregledom in analizo spisa Okrožnega državnega tožilstva v Slovenj Gradcu smo ugotovili, da so policisti Policijske postaje Slovenj Gradec v celoti pravilno ugotovili škodo za vse zaposlene oškodovane delavce, ki so jo izračunali na podlagi pridobljenih REK obrazcev s strani Davčne uprave Republike Slovenije. V nadaljnjem kazenskem postopku je bil aktiviran tudi sodni izvedenec, ki je prav tako izračunal oziroma ugotovil škodo za zaposlene delavce, katera se je ujemala z ugotovitvami policistov. Iz analize primera izhaja, da so se policisti pri izračunu zmotili le pri enem delavcu za dva centa. Ugotovili smo tudi, da so policisti Policijske postaje Slovenj Gradec v predkazenskem postopku zbrali dovolj dokazov, da je državni tožilec lahko nadaljeval kazenski pregon, direktorja podjetja pa sta bila na sodišču spoznana za kriva in obsojena na zaporno kazen.

Sekundarni povzetek:	This graduation paper consists of a presentation of an economic crime, the police and the State Prosecutor’s Office, as well as their cooperation in a pre-trial investigation concerning the investigation of an economic crime. The Police and the State Prosecutor’s Office have a key role in discovering and investigating economic crime in a pre-trial investigation in Slovenia. Local criminal police groups, the Economic Crime Division and the National Bureau of Investigation play an important role in the discovering and researching of financial crime in pre-trial investigations. The State Prosecutor’s Office or the State Prosecutor leads the pre-trial investigation and his/her role is to direct the police in gathering sufficient evidence in order to successfully continue criminal prosecution or a criminal procedure following the pre-trial investigation. The empirical part of the graduation paper is based on analysis prepared with the aid of the Internet and data from the State Prosecutor’s Office. As a sample we have taken data from annual police reports and an economic criminal act under consideration dealt with in the pre-trial investigation by the Slovenj Gradec Police Station. Further, we present the suspected company, Dural, d.o.o., and the evidence gathered by the police in the pre-trial investigation, where we have compared the theoretical findings of the police in the pre-trial investigation with the findings of the State Prosecutor’s Office in the further criminal procedure. Through our analysis we have established that the police are successfully investigating economic crimes and that the number of the economic crimes grew during the years 2008–2014 and after that started to decrease. By examining and analysing the file of the District State Prosecutor’s Office in Slovenj Gradec we have established that the police officers from the Slovenj Gradec Police Station have, in their entirety, correctly established the damage sustained by all injured employees, calculated on the basis of REK forms obtained from the Tax Administration of the Republic of Slovenia. In the subsequent criminal procedure a court expert has been activated, who also calculated or established the damage incurred by the employees, and his calculation matched the findings of the police officers. The case analysis shows that the police officers made only one miscalculation for one employee in the amount of two cents. We have also established that the police officers from the Slovenj Gradec Police Station collected sufficient evidence in the pre-trial investigation such that the State Prosecutor was able to continue the criminal prosecution, and the company’s directors were found guilty in court and sentenced to prison.
