Povzetek
Subsidiarnost je institut, ki je značilen za države s federalnim sistemom, prav tako pa tudi za Evropsko unijo, ki ni federacija, ampak predstavlja t.i. subjekt sui generis mednarodnega prava. Obstoječ institucionalni ustroj Unije sicer spominja na federativno ureditev, vendar pa države članice še vedno nadzorujejo svojo obrambno in zunanjo politiko ter kljub temu, da so del suverenosti prenesle na Evropsko unijo, povsem samostojno nastopajo v mednarodnih odnosih. V evropskem prostoru ekonomske, kulturne, politične, jezikovne in zgodovinske raznolikosti poteka proces intenzivne integracije s ciljem vse tesnejšega sodelovanja, ta proces in prostor pa obvladujejo nasprotujoče si potrebe po enotnosti in raznolikosti. Lahko bi dejali, da iz zapletenega koncepta "integracije raznolikosti" ali, kakor bi (še posebej v luči Brexita) dejali evroskeptiki, "integracije tistega, česar se integrirati ne da", izhaja tudi zapletenost struktur vladanja v Uniji. Kakor federacija ima tudi Evropska unija sistem z dvema ravnema oblasti. Eno predstavljajo države članice, ki ohranjajo pristojnosti, ki jih niso prenesle na Unijo, drugo pa Evropska unija, ki izvaja oblast ob upoštevanju načel subsidiarnosti in sorazmernosti. Glede na to, da Unija s svojim delovanjem ne posega le v mednarodno pravno sfero, temveč tudi v evropsko in nacionalno,vključno z regionalno in lokalno, mora delovati v okviru omenjenih načel in v skladu s koncepti nujnosti, učinkovitosti in sorazmernosti. V luči omenjenih konceptov subsidiarnost po eni strani predstavlja sredstvo za določitev ustrezne ravni delovanja, po drugi pa sredstvo za pomiritev nasprotujočih si potreb po enotnosti in raznolikosti znotraj Evropske unije. Odločilno vpliva na to, da so odločitve znotraj Unije sprejete kar se da blizu državljanom, in hkrati zagotavlja upravičenost ukrepanja evropske ravni v odnosu do nacionalnih, regionalnih ali lokalnih oblasti.

The subsidiarity is a concept typical for states with federal system and also for European Union although it is not federation but so called subject "sui generic" of an international law. The existing institutional structure of the Union resembles a federal arrangement, but Member States still control their defence and foreign policy, and although they have transferred part of their sovereignty to the European Union, they are fully independent in international relations. In the European space of economic, cultural, political, linguistic and historical diversity, the process of intensive integration is under way, with the goal of increasing cooperation. However this process and space is managed by contradictory needs of unity and diversity. It would be possible to assert that from the complex concept of "integration of diversity" or (especially in the light of Brexit) as the Euro sceptics would say "the integration of what can not be integrated", derives also the complexity of governance structures in the Union. Like the federation, the European Union has a two-level system of government. One is represented by the Member States which retain the powers that have not been conferred to the Union, and the other is the European Union exercising power while respecting the principles of subsidiarity and proportionality. Given that the Union does not only affect the international legal sphere, but also the European, national including regional and local, it must act within the framework of these principles and in accordance with the concepts of necessity, efficiency and proportionality. In the light of the aforementioned concepts, subsidiarity, on the one hand, represents a means of determining an appropriate level of action, and another means of reconciling the contradictory needs for unity and diversity within the European Union. It has a decisive impact that decisions within the Union are accepted as close as possible to citizens, while at the same time ensuring the legitimacy of action at European level in relation to national, regional or local authorities. |
