Povzetek
Veliko ljudi meni, da si osebe v zaporih ne zaslužijo kakovostnega in prijetnega bivanja, temveč samo gole stene in rešetke. Kljub temu se so se skozi zgodovino vsi zapori spreminjali v to smer, da bi bili čim bolj humani in udobni za bivanje. Večina slovenskih zaporov je starih, prav tako pa niso bili zgrajeni za zapiranje oseb, zato se zdaj pojavljajo težave, vezane na prostorsko problematiko, temu pa sledi tudi prezasedenost, saj še nikoli ni bilo zaprtih toliko oseb, kot jih je v današnjem času, sicer pa tudi populacija prebivalstva nenehno raste. Osnovna težava slovenskih zaporov je prezasedenost, posledično pa tudi zagotavljanje kakovostnega bivanja v smislu dela, izobraževanja, prostega časa in higiene. Na to dejstvo že več let opozarjata predvsem Odbor za preprečevanje mučenja in nehumanega ali ponižujočega ravnanja in kaznovanja pri Svetu Evrope in Varuh človekovih pravic. Težave, ki se pojavljajo, so zagotavljanje prostora, reda in discipline, izvajanje programov zdravstvenega varstva, nezaposlenost, premalo športnih dejavnosti in izobraževanj ter neustrezne higiensko-bivalne razmere in skrb za lastno higieno. Posledice so premalo prostora za obsojenca, pomanjkanje opreme, nevzdrževanje higiene, večja možnost konfliktov in nasilja, težje izvajanje programov in nadzora ter preobremenjenost zaposlenih. Navkljub vsem težavam Slovenija uspešno rešuje problematiko prezasedenosti s premeščanjem med zavodi, omogočanjem zaprtim osebam, da dlje časa preživijo izven bivalnih prostorov, in neprestanimi izboljšanji bivalnih razmer. V diplomskem delu je predstavljen Zavod za prestajanje kazni zapora Maribor, ki je v zgradbi, ki je med najstarejšimi temu namenjenimi zgradbami v Sloveniji. Vpet je v mestno središče in brez zelenih površin, poleg tega pa se že več let sooča s prostorsko problematiko. Reševanje prostorske problematike bi se moralo nanašati na svobodnejši režim in izvrševanje zapornih kazni v eni izmed alternativnih oblik prestajanja kazni.

Spatial problems and the impact on serving prison sentences |

Many people think that prisoners do not deserve a pleasant accommodation, but only walls and bars. However, through history all prisons changed enabling a more humane and comfortable accommodation. Most Slovenian prisons are old and they were not build to imprison people, therefore problems regarding spatial issues are appearing, followed by overcrowding, since there were never so many people imprisoned as nowadays; the population is also increasing. Overcrowding is the main problem of Slovenian prisons, resulting in poor conditions of living quality regarding jobs, education, free time and hygiene. The European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment and the Human Rights Ombudsman are pointing out this issue for many years now. The problems occurring are lack of space, order and discipline, issues in performing health care programmes, unemployment, lack of sport activities and education as well as inadequate hygiene and living conditions and care of one’s hygiene. The consequences are lack of space for prisoners, lack of equipment, inadequate maintenance of hygiene, higher possibilities for conflicts and more aggression, difficulty in programme implementation and control as well as overloading of employees. Slovenia is, despite all problems, successfully solving the issue of overcrowding by transferring prisoners between prisons, enabling them to spend more time outside of their accommodation as well as continuous improvements of living conditions. The diploma paper represents the prison Maribor, which is placed in one of the oldest buildings amongst prisons in Slovenia. Placed in the city centre with no green areas it is facing spatial problems for many years. The spatial problem should be solved with a more open regime and by serving the sentence in an alternative form of imprisonment. |
