Povzetek
Diplomska naloga obravnava pravno ureditev pravice do stavke policije in obseg dela policistov v času stavke. Naloga je zasnovano v dveh delih, teoretičnem in empiričnem. Teoretični del naloge zajema pravno ureditev pravice do stavke v mednarodnih aktih, Ustavi RS, zakonih in posebna določila, ki veljajo za javne uslužbence. V nadaljevanju je predstavljena pravna ureditev, ki ureja izključno področje pravice do stavke policistov. V empiričnem delu smo izvedli kvalitativno raziskavo, in sicer intervjuje. Intervjuvali smo tri policiste in predstavnika Policijskega sindikata Slovenije. Ugotovitve v empiričnem delu kažejo, da je pravica do stavke policije zelo omejena. Policisti v času stavke neprekinjeno zagotavljajo varnost države in državljanov. Njihove naloge v času stavke so določene z zakonom in morebitna kršitev je sankcionirana. Intervjuvanci so poudarili, da je omejevanje pravice do stavke v poklicu, kot je policija, nujno potrebno zaradi zagotavljanja reda in miru v državi. Ta morata biti zagotovljena neprekinjeno, kar pomeni, da policisti v času stavke dela ne prekinejo. Kljub temu pa policisti stavkajo, ne da bi s tem kršili zakon, z izdajo opozoril za manjše prekrške, s poostrenimi nadzori na mejah, itd. Pogajanj z vlado se udeležujejo sindikati s kredibilnimi in strokovno podkovanimi pogajalci, ki so sposobni predstavnikom delodajalca ustrezno predstaviti argumente za izpolnitev podanih zahtev.

The thesis deals with the legal regulation of the right to strike by the police and the prescribed tasks that police officers must assure during the strike. The thesis is composed of two parts, a theoretical part and an empirical part. The theoretical part of the thesis covers the legal regulation of the right to strike in international acts, the Constitution of the Republic of Slovenia and special acts applicable to civil servants. The legal framework governing the right to strike by police officers is presented separately. In the empirical part we conducted a qualitative research, namely interviews. We interviewed three police officers and a representative of the Slovenian Police Union. The findings in the empirical part show that the right to strike by the police is very limited. Police officers must ensure the safety of the state and its citizens at all times, and also during the strike. Their duties at the time of the strike are determined by law and any violation is sanctioned. Interviewees stressed that restricting the right to strike in a profession such as the police is essential in order to ensure law and order in the country. These must be provided on a continuous basis, which means that police officers must not interrupt their work during a strike. Nonetheless, police officers can strike without violating the law % they issue warnings for minor offenses, tighten border controls, etc. Negotiations with the government are performed by the Union. The Slovenian Police Union has credible and knowledgeable negotiators, who are able to adequately present the arguments of the employer to meet the given requirements. |
