Povzetek

Predmet magistrskega dela je prikaz normativnega urejanja položaja domorodnih ljudstev v nacionalnem pravu izbranih držav in v mednarodnem pravu. Domorodna ljudstva so bila v preteklosti pogosto diskriminirana s strani prevladujočih kolonialnih ljudstev ter deležna asimilacije in prisilne integracije v dominantne družbe. Njihov način življenja je preprost in iskren ter v skladu z naravo, kar pomeni, da v njej ne puščajo stalnih vidnih sledi. Posebej so navezani na zemljo in so z njo duhovno povezani, tako da jim ta predstavlja del njihove kulture, kot tudi način življenja in vir preživetja. S tem, ko so si drugi narodi podredili domorodna ljudstva, pa so ogrozili njihov način življenja, identiteto in obstoj. Zaradi asimilacije in prisilne integracije so morala sprejeti tuje pravne rede, bila so prisilno asimilirana ali integrirana v dominantno družbo, zaradi česar niso mogla več uporabljati zemlje, ki so jo poprej uporabljali njihovi predniki, onemogočena jim je bila raba njihovega jezika, prakticiranje religije itd. V mednarodni skupnosti ni bilo veliko zanimanja za urejanje področja domorodnih ljudstev in manjšin, saj je prevladovalo mnenje, da je to v domeni in suverenosti nacionalnih držav. Po II. svetovni vojni pa se je z razmahom in razcvetom človekovih pravic in vse večjega političnega aktivizma pričelo tudi urejanje teh področij na mednarodni ravni.V magistrskem delu so med drugim predstavljeni Samiji, domorodno ljudstvo, ki je edino domorodno ljudstvo v Evropi, razdeljeno znotraj meja štirih držav. Predstavljeno je, kako se razlikuje njihov pravni položaj v teh državah.

Sekundarni povzetek: The subject of the master's thesis is the presentation of the normative regulation of the position of indigenous peoples in the national law of selected countries and in international law.In the past, indigenous peoples were often discriminated against by the dominant colonial peoples, and were subjected to assimilation and force integration into dominant societies.Their way of life is simple and honest and in intertwined with nature, so it does not leave any permanent visible traces in it. They are especially attached to the earth, and share a spiritual link with it, so that it forms a part of their culture, integral part of their way of life and main source of livelihood.But when the indigenous peoples were subordinated to other nations, their way of life, identity and existence became endangered. Because of assimilation and forced integration policies, they had to accept foreign legal orders and were forcefully assimilated or integrated into the dominant society, which made them no longer able to use the land that their ancestors used before, prevented them from using their language, practicing religion, etc. There was not much interest in the international community in regulating the subject of indigenous peoples and minorities since it was believed that this belonged in the domain and sovereignty of national states. After II. World War II, with the expansion and flourishing of human rights and increasing political activism, the regulation of these areas on the international level began.The Saami people are also presented in the Master's thesis. They are the only indigenous people in Europe and are one nation divided among the borders of four countries, which means their situation, legal status and rights are different in every State.
