Povzetek
Magistrsko delo je posvečeno vsakomur, ki se seznanja z ureditvijo gradbenega dovoljenja oziroma vsakomur, ki se bo spustil v postopek gradnje objekta. Gradbeno dovoljenje je institut, ki je že nekaj časa poznan v pravnih sistemih po svetu. Ker gre gradbeništvo z roko v roki z razvojem in poselitvijo, se je z leti zakonodaja spremenila. Pogoji za pridobitev gradbenega dovoljenja so tako postali strožji in obširnejši. Ne glede na zakonodajo pa potreba po gradnji objektov ostaja in se nenehno povečuje, zato se ureditev pogosto znajde pod drobnogledom. S spremembo gradbene zakonodaje se je pravna panoga usmerila k ureditvi razvitih držav, kjer so administrativne ovire in zaostanki ter dolgotrajnost postopkov zgolj preteklost. Prejšnja ureditev je bila obremenjujoča tako za investitorje kot za javne uslužbence, ki so bili soočeni z obsežno dokumentacijo, ki je potrebna za pridobitev gradbenega dovoljenja. Legalizacija nelegalnih objektov je postala izvedljiva in dostopna za vsak žep. Prostorsko načrtovanje in projektna dokumentacija sta bistvena pogoja, brez katerih sama gradnja objektov ni izvedljiva. V magistrskem delu se posvetim hipotezam, ali gradbeno dovoljenje po uvedenih spremembah sledi javnemu interesu, ali je legalizacija nelegalnega objekta zahtevna in potrošna ter ali je celoten proces postopka pridobitve gradbenega dovoljenja nerazumljiv in zapleten. V magistrskem delu se bodo prepletale metode deskripcije, komparativna metoda in analitično-deduktivna metoda. Cilj magistrskega dela je predstaviti trenutno ureditev gradbene zakonodaje, preučiti, kako se je ureditev modernizirala, in predlagati možne izboljšave.

This Master's Thesis is dedicated to everyone who is getting familiarized with the process of obtaining a building permit or to anyone who is about to start building. A building permit is an institution long known in legal systems all over the world. Since civil engineering goes hand in hand with development and urbanisation, the legislation has changed in recent years. The conditions for obtaining a building permit have thus become stricter and more extensive. Regardless of the legislation, the need to build remains and constantly increases, which is why such regulations are often put under a microscope. With the change in building legislation, the legal branch has shifted its focus to the regulations in developed countries, where such administrative barriers, backlogs and lengthy procedures are only a thing of the past. The previous regulation was burdensome for both investors and civil servants, who have been faced with extensive documentation that is required when obtaining a building permit. The legalisation of illegal constructions has become feasible and affordable for everyone. Spatial planning and project documentation are the essential conditions that have to be fulfilled if a construction is to be realised. This Master's Thesis will focus on hypotheses whether the building permit - after the recent changes have been made - still follows public interest; whether the legalisation of an illegal construction is difficult and expensive; and whether the whole process of obtaining a building permit is incomprehensible and complicated. Descriptive method, comparative method and analytical-deductive method will be used in this Master's Thesis. The aim of this Master's Thesis is to present the current regulation of the construction legislation, to examine how the regulation has been modernised and to suggest possible improvements. |
