Povzetek

Namen prispevka: Namen tega prispevka je, da oriše načelo vzporednosti zahtevka po zakonitem in legitimnem delovanju slovenske milice v času prizadevanj za demokratizacijo naše družbe, še posebej v času prepovedanega mitinga 1. decembra 1989 v Ljubljani. Metodologija: Uporabljena je bila metoda analize pisnih virov, strokovnih del, predvsem pa nekaterih dokumentov, zakonov in predpisov, ki omogočajo analizo transformacije milice v daljšem časovnem obdobju, vse do osamosvojitvenih procesov. Ugotovitve: Vsebina zakonskih predpisov, ki so določali naloge in pooblastila milice, ter strokovni napotki za njihovo izvajanje so bili izraz in odraz družbenih ter varnostnih razmer v povojni Jugoslaviji in Sloveniji. Vse bolj so na tem področju prihajale do veljave razmere v Sloveniji, saj so njene pristojnosti praviloma stalno naraščale, zvezne pa upadale. Pomen človekovih pravic in svoboščin se je širil tudi v predpisih za delovanje milice, kar je našlo izraz zlasti v pravilih za opravljanje njenih nalog. Vsebina, kaj so naloge milice, se je pokazala v napotkih, kako te naloge izvrševati. Obe načeli, zakonitost in legitimnost, sta prišli do polnega izraza zlasti v ukrepih organov za notranje zadeve, določenih ob napovedanem mitingu v Ljubljani, kjer lahko ugotovimo, da je takratna milica ravnala legitimno v dvojnem pomenu. Prvič, ker je varovala pravice in svoboščine posameznika, in drugič ker je varovala pravico slovenskega naroda do samoodločbe in do življenja v lastni državi. Omejitve/uporabnost raziskave: Ugotovitve se nanašajo izključno na milico in organe za notranje zadeve v Sloveniji. Praktična uporabnost: Analiza prispeva k razumevanju transformacije milice in organov za notranje zadeve in njihovega postopnega prilagajanja na spremenjeno politično, družbeno in varnostno okolje, ki je kulminiralo v osamosvojitvenih procesih Slovenije. Izvirnost/pomembnost prispevka: Transformacija milice in organov za notranje zadeve je analizirana v daljšem časovnem obdobju in tako načenja mit, da so spremembe v zakonitosti in legitimnosti njihovega delovanja nastopile šele po 1. decembru 1989 ali celo z osamosvojitveno vojno leta 1991.

Sekundarni naslov: The Efforts to Ensure the Legitimacy of the Activities of the Police Force
Sekundarni povzetek: Purpose: The purpose of this article is to outline the principle of the parallel claims regarding the lawfulness and legitimacy of the activities carried out by the Slovenian police force during the efforts to democratise society, particularly during the banned rally in Ljubljana on 1 December 1989. Methodology: The method employed was to carry out an analysis of written sources and expert works, primarily certain documents, laws, and regulations which enable an analysis of the transformation of the police force over an extended period of time up to the independence processes. Findings: The content of the legal regulations which determined the tasks and powers of the police force, as well as the professional directions for their implementation, were an expression and reflection of the social and security conditions in the post-World War Two Yugoslavia and Slovenia. In this field the conditions in Slovenia were becoming increasingly important, since, as a general rule, Slovenia’s competences were constantly expanding, whereas those of the federal state were decreasing. The importance of human rights and freedoms was also spreading to the regulations governing the functioning of the police force, which was expressed particularly in the rules for carrying out its tasks. The content – what the tasks of the police forces are – was shown in the directions on how to execute these tasks. Both principles, the principles of lawfulness and legitimacy, were fully expressed particularly in the measures implemented by the internal affairs bodies on the occasion of the announced rally in Ljubljana, regarding which we can establish that the then police acted lawfully in a double sense. Firstly, because they protected the rights and freedoms of the individual, and secondly, because they protected the right of the Slovenian nation to self-determination and a life in its own country. Research limitations/implications: The findings refer solely to the police force and internal affairs bodies of Slovenia. Practical implications: The analysis contributes to an understanding of the transformation of the police force and the internal affairs bodies and their gradual adaptation to the changed political, social, and security environment, which culminated in Slovenia’s independence process. Originality/Value: The transformation of the police force and internal affairs bodies is analysed over an extended period of time and thus punctures the myth that the changes, in the sense of the lawfulness and legitimacy of their functioning, occurred only after 1 December 1989 or even with the war of independence in 1991.
