Povzetek
Policija je organ izvršilne oblasti, ki v družbi opravlja tako preventivne kot represivne naloge. Za učinkovito opravljanje zakonitih policijskih nalog se policija srečuje tudi z uporabo različnih prisilnih sredstev, da lahko tako zagotavlja spoštovanje reda, zakonodaje in predpisov. Namen uporabe prisilnega sredstva je, da se osebo, ki napada, ogroža druge, se upira ali ne izpolni zakonitega ukaza policista, podredi zahtevam policista, pri čemer pa je najpomembnejše upoštevanje temeljih načel, predvsem načel zakonitosti, strokovnosti in sorazmernosti, poleg teh pa je policist dolžan upoštevati tudi posebna izvedbena dopolnilna načela.
V drugem poglavju je obravnavana tema o uporabi prisilnih sredstev, ki so del splošnih policijskih pooblastil. Opisana so temeljna in dopolnilna načela za uporabo le-teh, ter zakonodaja, ki ureja uporabo prisilnih sredstev, saj uporaba kateregakoli prisilnega sredstva pomeni poseg v temeljne človekove pravice.
V tretjem delu so opisana različna prisilna sredstva, ki se lahko smatrajo tudi za sekundarna policijska pooblastila in katera imajo na voljo policisti za učinkovito ter uspešno opravljanje svojega dela proti posamezniku in proti množici ter uporaba strelnega orožja in opozorilnega strela, ki pa se ne šteje kot prisilno sredstvo.
V zadnjem, empiričnem, delu je predstavljena analiza in primerjava statističnih podatkov uporabe prisilnih sredstev na območju PU Kranj v obdobju 2013–2018 in po posameznih enotah ter analiza in primerjava posledic same uporabe prisilnih sredstev tako pri policistih kot pri kršiteljih s slovenskim povprečjem. Glede na splošno mnenje, da je uporaba prisilnega sredstva uporabljena prevečkrat, je tudi prikazano, kolikokrat so bila v tem obdobju uporabljena prisilna sredstva in opozorilni strel po posameznih enotah PU Kranj.

The police are the enforcement authority, which perform both preventive and repressive tasks. To effectively carry out the purposes of the legitimate law enforcement duties, the police is faced with using a variety of force means, to ensure their compliance with policy, legislation and regulations. The purpose of use the force means is, that the person who attacks, threatens others, resists or does not meet the lawful command of a police officer, is yield to police requirements and the most important is to observe the basic principles of legality, professionalism an proportionality and in addition to these, beside that is police officer also obliged to take into account the specific complementary principles.
The second chapter deals with the topic of the use of force means, which are part of general police powers. Described are basic and complementary principles and the legalisation governing the use of coercive means, since the use of any coercion means is intervetion in fundamental human rights.
In the third chapter are described the various coercive means which might be considered as secondary police powers and are available to police officers to effectively and successfully carry out their work against individuals and crowd, and the use of firearms and warning shot, which are not to be considered as coercive means.
In the last, empirical, part is presented the analysis and comparison of statistical data on the use of coercive means in Police district Kranj in period of 2013 – 2018 and by individual units and analysis and comparison of consequences of the use of coercive means by both police officers as well as offenders with Slovenian average. Considering the overall opinion, that the use of coercive means is used too often, it is also shown how many times during that period the coercive means and warning shots were used by each unit in PU Kranj. |
