Povzetek
Pri urejanju ekonomskega in socialnega položaja posameznika in družine igra država veliko vlogo in ima veliko odgovornost, ker temelji na določbah ustave in mednarodnih aktov, ki jo zavezujejo. Slovenska ustava določa, da je Slovenija pravna in socialna država, zato mora država z zakoni določiti in urediti pravice, s katerimi se uresničujejo ustavna človekova pravica do socialne varnosti, do zdravstvenega varstva in druge socialne pavice, ki so v ustavi določene. Na socialni položaj ljudi v družbi pomembno vpliva sistem socialne varnosti, ki ga skladno s socialno politiko organizira država. Leta 2012 so v Sloveniji uvedli novo socialno reformo, ki je to področje močno spremenila. V veljavo sta stopila dva zakona, in sicer Zakon o uveljavljanju pravic iz javnih sredstev in Zakon o socialno varstvenih prejemkih. V diplomskem delu predstavljamo spremembe, ki sta jih prinesla omenjena zakona, vendar se pri tem osredotočamo le na denarno socialno pomoč. Pri raziskovanju literature smo uporabili deskriptivno metodo, saj gre za analizo postopkov, procesov in dejstev, metodo kompilacije, saj smo povzemali stališča, spoznanja, ter teoretično primerjalno metodo. V empiričnem delu pa smo uporabili analitično in statistično metodo. Pri analizi statističnih podatkov, kot tudi spremenjene zakonodaje, smo ugotovili, da od leta 2012 delež prejemnikov denarne socialne pomoči narašča. Eden od razlogov je ta, da se ob uvedbi dodatka za delovno aktivnost poveča prihodek s strani države, tako da so določeni posamezniki ugotovili, da se jim redno zaposliti praktično "ne splača". Drugi razlog pa je gotovo tudi ta, da je denarna socialna pomoč dovolj visoka v primerjavi z minimalno plačo, kar je tudi razlog, da se določeni posamezniki ne želijo redno zaposliti.

The government plays a major role in regulating the economic and social situation of an individual and the family. The state also has a great responsibility as it has to act in accordance with the provisions of the Constitution and other international acts and treaties by which it is bound. The Constitution of the Republic of Slovenia stipulates that Slovenia is a state governed by the rule of law and a social state, which means that the government is obligated to adopt the laws and regulate the rights of the citizens to enforce their constitutional right to social security, health care and other social rights laid down in the Constitution. The social status of people in society is greatly affected by the system of social security which the state puts in place in line with its social policy. In 2012, Slovenia adopted a reform of its social system, which has led to major changes in the social security landscape. Two new acts came into force, namely the Exercise of Rights from Public Funds Act and the Social Assistance Payments Act. The thesis presents the changes introduced by the above mentioned laws, with a sole focus on financial social assistance. In surveying the relevant literature we used the descriptive method because our aim was to analyse procedures, processes and facts; the compilation method because our aim was to sum up points of view and findings; and the theoretical comparison method. The analytical and statistical methods were used in the empirical part of the thesis. The analysis of statistical data and amended legislation showed that since the share of beneficiaries of financial social assistance (FSA) has been increasing since 2012. One of the reasons for this lies in the fact that the activity supplement is now added to the recipient's income transfers from the state, which is why full-time employment is not seen as an economically attractive option by certain FSA recipients. In addition, when compared to the minimum wage, FSA is relatively high, which is another reason why certain people are reluctant to seek permanent employment. |
