Povzetek
V diplomskem delu smo predstavili pomembno vlogo policistov pri preiskovanju in obravnavi storitve kaznivega dejanja v družini. Predstavili smo, kako kompleksno je preiskovanje kaznivega dejanja nasilja v družini s strani policistov. Za vsak primer preiskave nasilja v družini je za policiste ključno dobro poznavanje dinamike družinskega okolja in predkazenskega postopka ter kazenske zakonodaje.
Pri obravnavanju primerov smo ugotovili, da gre za zasebne prostore, kjer so družine izolirane, še toliko bolj, če v njih vlada nasilje. Gre za prikrito obliko nasilja, ki ga je težko prepoznati in preprečiti, z namenom pomagati oškodovancu in storilcu. V večini primerov žrtve o nasilju nočejo spregovoriti, saj ima kratkoročne in dolgoročne posledice (psihične, socialne in ekonomske). Zaradi teh posledic žrtve ne prijavijo nasilja ali pa v postopku na sodišču odstopijo od njega.
Osrednji del diplomskega dela obsega značilnosti nasilja v družini in pomembne dejavnike, ki vplivajo na dinamiko med družinskimi člani. Za kakovostno policijsko preiskavo je pomembno tudi poznavanje zakonodaje pri preiskovanju nasilja v družini, s katero zaščitijo oškodovanca. Opisali smo, da je nujno sodelovanje z drugimi organi in organizacijami pri preprečevanju ter obravnavi nasilja v družini. Zajeli smo organe in organizacije, ki na zakonski podlagi ukrepajo, s tem, da nudijo različne oblike pomoči z namenom zaščite oškodovanca in ukrepajo zoper povzročitelja nasilja. Vsi ti organi in organizacije niso dovolj, če žrtev ali storilec noče sodelovati z njimi. Ključno vlogo odigrajo, kadar imajo popolno sodelovanje z žrtvijo in s storilcem kaznivega dejanja nasilja v družini, saj le takrat lahko pomagajo žrtvi in rehabilitirajo storilca.
Opravili smo primerjavo policijske preiskave nasilja v družini, razmejitev med prekrškom in kaznivim dejanjem, med Republiko Slovenijo in Republiko Hrvaško. Primerjali smo zakonsko podlago, na podlagi katere lahko policisti ukrepajo. Zajeli smo število obravnav prekrškov in kaznivih dejanj v Republiki Sloveniji in Republiki Hrvaški ter jih prikazali v obliki tabel. Opisali smo delo policistov, državnih tožilcev in sodišč pri obravnavi nasilja v družini. Ugotovili smo, da se število obravnavanih kaznivih dejanj v Republiki Sloveniji in Republiki Hrvaški malo razlikuje. Opazna je razlika v zakonski obravnavi in v časovnem obdobju izvajanja ukrepov policije, državnih tožilcev in sodišč, ki zaščitijo žrtve ter preprečijo storilcu nadaljnje izvajanje nasilja v družini.
V diplomskem delu smo zajeli tudi nasilje nad starejšimi, ki ga v večini primerov težko odkrijemo, zato večinoma ostane skrito, saj so žrtve izolirane. Opisali smo elemente in družinsko dinamiko, zakaj pride do pojava nasilja v družini ter razloge, zakaj večinoma časa ostaja skrito. Na podlagi statističnih podatkov smo prikazali, da je odstotek povzročiteljev nasilja srednjih let in zelo majhen odstotek starostnikov.
V analizi primera smo predstavili primer obravnavanega nasilja v družini na območju Policijske uprave Ljubljana. Predstavljeni so kompleksni odnosi med družinskimi člani, ki so imeli pomembno vlogo, da je prišlo do preiskave nasilja v družini. S primerom sem želel izpostaviti, kako pomembno je zgodnje odkrivanje nasilja, ki posledično vpliva na nadaljnje ukrepe policije in različnih organov in organizacij.

In the diploma work, we presented the important role of police officers in investigating and dealing with the commission of a criminal offense in the family. We presented how complex the investigation of the crime of domestic violence by police officers is. For each case of investigation of domestic violence, a good knowledge of the dynamics of the family environment and pre-trial proceedings, as well as criminal law, is crucial for police officers.
In dealing with the cases, we found that these are private spaces where families are isolated, all the more so if there is violence in them. It is a covert form of violence that is difficult to identify and prevent in order to help the victim and the perpetrator. In most cases, victims do not want to talk about violence, as it has short-term and long-term consequences (psychological, social and economic). Because of these consequences, victims do not report violence or withdraw about it in court proceedings.
The central part of the diploma thesis covers the characteristics of domestic violence and important factors influencing the dynamics among family members. For a quality police investigation, it is also important to know the legislation in the investigation of domestic violence, which protects the victim. We described the need for cooperation with other bodies and organizations in the prevention and treatment of domestic violence. We covered the bodies and organizations that act on a legal basis by offering various forms of assistance in order to protect the victim and to take action against the perpetrator of violence. All of these bodies and organizations are not enough if the victim or perpetrator refuses to cooperate with them. They play a key role when they have full cooperation with the victim and perpetrator of the crime of domestic violence. Only then can they help the victim and rehabilitate the perpetrator.
We compared the police investigation of domestic violence, the distinction between a misdemeanor and a criminal offense between the Republic of Slovenia and the Republic of Croatia. We compared the legal basis on which police officers can take action. We covered the number of cases of misdemeanors and criminal offenses in the Republic of Slovenia and the Republic of Croatia and presented them in the form of tables. We described the work of police officers, state prosecutors, and courts in dealing with domestic violence. We found that the number of criminal offenses in question in the Republic of Slovenia and the Republic of Croatia differs slightly. There is a noticeable difference in the legal treatment and in the time period for the implementation of measures by the police, state prosecutors and courts, which protect victims and prevent the perpetrator from continuing to commit domestic violence.
The diploma thesis also covers violence against the elderly, which in most cases is difficult to detect, so it mostly remains hidden, as the victims are isolated. We described the elements and family dynamics of why domestic violence occurs and the reasons why it remains hidden most of the time. Based on statistics, we have shown that the percentage of perpetrators of violence is middle-aged and a very small percentage of the elderly.
In the analysis of the case, we presented a case of domestic violence in the area of the Ljubljana Police Administration. The complex relationships between family members, which played an important role in the investigation of domestic violence, are presented. With the example, I wanted to highlight the importance of early detection of violence, which in turn affects the further action of the police and various bodies and organizations. |
