Povzetek
Javno pooblastilo je ustavni institut in z drugimi besedami pomeni prenos izvajanja upravnih nalog na subjekt izven državne oziroma občinske uprave. Podeli se lahko pravnim osebam javnega in zasebnega prava ter fizičnim osebam z namenom povečanja učinkovitosti in racionalnosti izvajanja upravnih nalog ter zmanjšanja neposrednega vpliva politike. Namen diplomskega dela je bil raziskati področje javnih pooblastil v povezavi z mestnimi občinami. Osredotočili smo se na javna pooblastila izvajalcem gospodarskih javnih služb. Zanimalo nas je, katere so naloge, ki se najpogosteje podelijo z javnimi pooblastili, ter kakšna so razmerja med mestnimi občinami in nosilci javnih pooblastil. V diplomskem delu smo analizirali vsebino občinskih odlokov, s katerimi so mestne občine izrecno podelile javna pooblastila, in ugotavljali, katere naloge se najpogosteje pojavljajo. S pomočjo analize predpisov in anketnega vprašalnika smo ugotavljali, kakšna so razmerja med mestnimi občinami in nosilci javnih pooblastil. Ugotovili smo, da se z javnim pooblastilom najpogosteje prenašajo naloge izdajanja soglasij, izdajanja pogojev ter podajanja smernic. Ugotovili smo tudi, da več kot polovica mestnih občin spremlja izvajanje javnih pooblastil, slabši pa so rezultati pri nudenju strokovne pomoči in nadzoru. Diplomsko delo prispeva k poznavanju instituta javnih pooblastil v zakonodaji in praksi na občinski ravni in nudi izhodišča za nadaljnje raziskovanje tako pravne ureditve kot njenega izvajanja.

Analysis of the implementation of public authorities in urban municipalities |

Public authority is a constitutional institute, in other words, the transfer of the performance of administrative tasks to an entity outside state or municipal administrations. It may be granted to legal and natural persons, as well as private and public law persons, with a purpose to increase the efficiency and rationality of the performance of administrative tasks and to reduce the impact of policy. The purpose of the diploma work was to explore the field of public authority in connection with urban municipalities. We focused on public authorities granted to public utility service providers. We were interested in which tasks are most often granted with public authorities and how are the relations between urban municipalities and holders of public authority. In the bachelor's thesis, we analyzed the content of municipal ordinances, with which urban municipalities explicitly grant public authorities and determined which tasks are most often conferred. With the help of analysis of regulations and a survey, we determined the relations between urban municipalities and holders of public authority. We have found that public authority most often delegates the tasks of issuing consents, issuing conditions and giving guidelines. We also found that more than half of urban municipalities monitor the exercise of public authority, while the results of providing professional assistance and supervision are worse. The bachelor's thesis contributes to the knowledge of the institute of public authority in legislation and practice on the municipal level and also offers starting points for further research of both: legal regulations and its implementation. |
