Povzetek

Postopek za prevzem izvršitve kazenske sodbe tujega sodišča je postopek mednarodne kazenskopravne pomoči. Pravila postopka so med državami določena predvsem v mednarodnih pogodbah, osnovna pravila pa so zakonsko urejena v vsaki posamezni državi. V slovenskem pravnem redu ta postopek urejata Zakon o kazenskem postopku (v nadaljevanju: ZKP) in Zakon o sodelovanju v kazenskih zadevah z državami članicami Evropske unije (ZSKZDČEU-1). V ospredju presoje bodo procesna jamstva tega postopka, saj zakon obsojencu, katerega tuja sodba se priznava v Republiki Sloveniji, daje, po mnenju avtorice, zelo malo pravic. Procesne pravice v kazenskem pravu so bistvene za zagotavljanje enakosti orožij in že zaradi spoštovanja Ustave Republike Slovenije (v nadaljevanju: URS) morajo biti v določeni meri tudi zagotovljene. Predstavljena bo tudi sodna praksa, ki je zaradi šibke pravne ureditve na tem področju nadvse pomembna. Posebej izpostavljen bo sklep Vrhovnega sodišča Republike Slovenije opr. št. I Ips 79/2010 z dne 14. 7. 2011, s katerim se je spremenil sam status postopka prevzema in izvršitve tuje sodbe in prispeval k ukinitvi izrednega pravnega sredstva, in sicer možnosti vložitve zahteve za varstvo zakonitosti v postopku za prevzem izvršitve kazenske sodbe tujega sodišča ter s tem k znižanju stopnje obsojenčevih procesnih jamstev. Obravnavani bodo tudi problemi tega postopka in predstavljene možne rešitve, ki bi obsojencu kot enakopravni stranki v postopku v prvi vrsti zagotovile več, z ustavo zagotovljenih procesnih jamstev s pomočjo katerih se lahko uspešno brani.

Sekundarni povzetek: The procedure for taking over the execution of a criminal judgment of a foreign court is the procedure of international criminal legal assistance. The rules of procedure between countries are determined primarily in international treaties, and the basic rules are regulated in each individual country. In the Slovenian legal system, this procedure is regulated by the Criminal Procedure Act (hereinafter: CPA) and the Act on Cooperation in Criminal Matters with the Member States of the European Union (ACCMWMSEU-1). According to the author, procedural guarantees of this procedure will be at the forefront of the assessment, as the law gives a convict whose foreign judgment is recognized in the Republic of Slovenia very few rights. Procedural rights in criminal law are essential to ensure the equality of legal remedies and, in order to respect the Constitution of the Republic of Slovenia (hereinafter: the CRS), they must also be guaranteed to a certain extent. The judicial practice, which is extremely important due to the weal legal regulation in this area, will also be presented. The decision of the Supreme Court of the Republic of Slovenia ref. no. I Ips 79/2010 of 14 July 2011, which changed the status of the procedure for taking over and enforcing a foreign judgment and contributed to the abolition of an extraordinary legal remedy, namely the possibility of filing a request for protection of legality in the procedure for taking over the execution of a foreign judgment courts and thus to lower lever of the convict's procedural guarantees. The problem of this procedure will also be discussed, and possible solutions will be presented, which would provide the convict, as an equal party in the procedure, primarily with more procedural rights guaranteed by the Constitution, with the help of which he can successfully defend himself.
