Povzetek
Daytonski mirovni sporazum (DMS) se po načinu sklenitve, garantih, vsebini in številnih drugih značilnostih razlikuje od tipičnih mednarodnih pogodb. Del DMS je nova Ustava BiH, ki določa organizacijo državne oblasti in državno ureditev. DMS je zaustavil vojno v BiH in ohranil zgodovinske meje BiH ter njeno ozemeljsko celovitost in mednarodno subjektiviteto. Leta 1995 je to bil osupljiv in presenetljiv uspeh, ki je ustavil grozovito tragedijo na evropskih tleh. Danes pa DMS povezujemo bolj z disfunkcionalnostjo kot z mirom, saj sicer je omogočil življenje brez vojne, a nikoli povsem v miru. Delno zato, ker je bil sporazum bolj premirje kot instrument trajnega miru in stabilnosti. Izhaja namreč iz dejanskega stanja, ustvarjenega z agresijo in genocidom, in na tej podlagi "legalizira" nastanek ekskluzivnih nacionalnih ozemelj. Od takrat so etnonacionalisti manipulirali z določbami DMS, da bi utrdili svojo moč na račun sposobnosti preživetja države. Večina institucij, ki jih je ustvaril DMS, je nastala na segregacijskih osnovah, zato ne ustrezajo mednarodno priznanim standardom človekovih pravic in svoboščin, saj številne daytonske institucije ljudi diskriminirajo in ločujejo. Zato "daytonska BiH" ni zmožna avtonomnega delovanja brez pomoči mednarodne skupnosti, ki pa se v zadnjih dveh desetletjih ni neposredno vmešavala v notranje zadeve BiH, kar je povzročilo krepitev nacionalističnih delitev v državi. Spremembe, ki jih novi visoki predstavnik vnaša v institucije BiH, izzivajo različne reakcije tako mednarodne skupnosti kot notranjih političnih akterjev v BiH. V nalogi analiziram, kako lahko mednarodna skupnost z mednarodnopravnega vidika prispeva k "popravi" DMS.

The Dayton Peace Agreement (DMS) differs from typical international treaties in terms of the method of conclusion, guarantees, content and many other features. Part of the DMS is the new Constitution of BiH, which determines the organization of state power and state regulation. DMS stopped the war in BiH and preserved the historical borders of BiH as well as its territorial integrity and international subjectivity. In 1995, it was a stunning and surprising success that stopped a terrible tragedy on European soil. DMS, however, is more associated today with dysfunctionality than peace, as it allowed life without war, but never completely at peace. Partly because the agreement was more of a truce than an instrument of lasting peace and stability. It originates from the actual situation created by aggression and genocide, and on this basis "legalizes" the creation of exclusive national territories. Since then, ethno-nationalists have manipulated the provisions of the DMS to consolidate their power at the expense of the country's viability. Since most Dayton institutions were created on the basis of segregation, they do not meet internationally recognized standards of human rights and freedoms, because they discriminate and separate people. Thus, the "Dayton BiH" cannot act autonomously without the help of the international community, which didn't directly interfere with the internal affairs of the country in the last two decades, thereby strengthening nationalist divisions. The changes that the new High Representative is bringing to the institutions of BiH provoke different reactions from both the international community and internal political actors in BiH. In the assignment, I analyze how the international community can contribute to "repairing" of the DMS from the international law point of view. |
