Povzetek
V času med 12. 3. 2020 in 31. 5. 2020 je bila z Odredbo o razglasitvi epidemije nalezljive bolezni SARS-CoV-2 (covid-19) na območju Republike Slovenije razglašena epidemija nalezljive bolezni SARS-CoV-2 (covid-19). Mediji so bili preplavljeni z informacijami o širjenju virusa, njegovih posledicah in o ukrepih za preprečevanje njegovega širjenja. Kmalu po razglasitvi epidemije so se v medijih začela vrstiti opozorila o nevarnostih porasta nasilja v družinah. Posredovana so bila zagotovila, da državni organi in organizacije, kljub omejitvam in ukrepom za preprečevanje širjenja bolezni, nasilje obravnavajo celovito kot pred epidemijo in da se žrtvam zagotavlja zaščita.
V diplomskem delu so predstavljeni pojmi nasilje, družina in nasilje v družini. Prav tako so prestavljene različne oblike nasilja v družini in pri tem navedeni konkretni primeri posamezne oblike nasilja. Izpostavljeni so organi in organizacije, ki delujejo na področju obravnave protipravnih ravnanj z elementi nasilja v družini in njihovi ukrepi ob tovrstnih obravnavah. Zajeta so protipravna ravnanja z elementi nasilja v družinskih skupnostih na področju kaznivih dejanj in prekrškov. Od kaznivih dejanjih je izpostavljeno kaznivo dejanje nasilja v družini po prvem odstavku 191. člena Kazenskega zakonika, ki je umeščeno v poglavje kaznivih dejanj zoper zakonsko zvezo, družino in otroke. Na področju prekrškov pa so izpostavljene kršitve četrtega odstavka 6. člena Zakona o varstvu javnega reda in miru (ZJRM-1) v povezavi s prvimi tremi odstavki navedenega člena.
Na podlagi statističnih podatkov Policije sta bili potrjeni dve tezi, in sicer da je Slovenska policija v prvem valu nalezljive bolezni SARS-CoV-2 (covid-19), med 12. 3. 2020 in 31. 5. 2020, ko je bila v Sloveniji prvič razglašena epidemija te nalezljive bolezni, obravnavala več kaznivih dejanj nasilja v družini po 191. členu KZ-1 ter da je v enakem obdobju obravnavala več prekrškov z elementi nasilja po četrtem odstavku 6. člena ZJRM-1.

Between March 12, 2020 and May 31, 2020, an epidemic of the SARS-CoV-2 infectious disease (COVID-19) was declared on the territory of the Republic of Slovenia by the Decision on the declaration of epidemic of transmissible disease SARS-CoV-2 (COVID-19) on the territory of the Republic of Slovenia. The media were flooded with information about the spread of the virus, its consequences, and measures to prevent its spread. Soon after the epidemic was declared, warnings about the dangers of rising domestic violence began to circulate in the media. Assurances were provided that, despite the restrictions and measures to prevent the spread of the disease, the violence is treated as prior to the epidemic and that protection is provided to the victims.
The thesis presents the terms violence, family and domestic violence. The different forms of domestic violence are also presented, with specific examples of each form of violence. The authorities and organisations active in the field of dealing with unlawful conduct with elements of domestic violence and their responses to such dealing are stressed out. This covers the unlawful handling with elements of violence in family communities in the field of crime and offences. Among the criminal acts, the crime of domestic violence according to the first paragraph of Article 191 of the Criminal Code (KZ-1) is stressed out. This is placed in the chapter of criminal acts against marriage, family and children. In the field of misdemeanours, however, violations of the fourth paragraph of Article 6 of the Law on the Protection of Public Order and Peace (ZJRM-1) in conjunction with the first three paragraphs of that Article are exposed. Based on the statistical data of the Police, two theses were confirmed, namely that during the first wave of the infectious disease SARS-CoV-2 (COVID-19), between March 12, 2020 and May 31, 2020, when in Slovenia an epidemic of this contagious disease was declared for the first time, the Slovenian Police dealt with more criminal acts of domestic violence according to Article 191 of KZ-1 and that in the same period it dealt with more misdemeanours with elements of violence according to paragraph 4 of Article 6 of the ZJRM-1. |
