Povzetek

Večosebna lastna razmerja predstavljajo posebno obliko lastninske pravice. Gre za primere, ko je lastnina razdeljena med več oseb. Poznamo dve osnovni obliki večosebnih lastnih razmerij in sicer solastnino ter skupno lastnino. Kot posebno obliko solastnine pa moramo omeniti še etažno lastnino. Bistvena lastnost večosebnih lastnih razmerij je v izvrševanju lastninske pravice, ki pripada več osebam. Solastnina je oblika lastninske pravice, katere temeljna lastnost je nerazdeljenost stvari, nad katero ima več oseb upravičenje izvrševanja pravne oblasti, v okviru njihovih idealnih deležev. Posebno obliko solastnine predstavlja etažna lastnina, ki se od solastnine razlikuje predvsem po delitvi stvari. Stvar v etažni lastnini je namreč razdeljena fizično in ne le navidezno, torej na idealne dele. Etažna lastnina predstavlja združitev dveh različnih oblik lastninskih razmerij, lastninskega na posameznih delih etažne lastnine ter solastninskega na skupnih delih. Največja razlika med skupno lastnino ter solastnino pa je, da pri skupni lastnini stvar ni razdeljena niti na idealne dele. Skupni lastniki lahko upravljajo le s stvarjo kot celoto. Prvi del diplomske naloge temelji na osnovah. Predstavila sem temeljna načela nepremičninskega prava ter pravne vire, ki so temelj urejanja večosebnih lastnih razmerij. Največji poudarek med pravnimi viri sem namenila Stvarnopravnemu zakoniku, ki predstavlja osnovo nepremičninskemu urejanju. V nadaljevanju sem predstavila pojem posesti, z namenom razlikovanja od lastninske pravice. Razlikovanje med pojmoma namreč še danes predstavlja težavo. Osnova večosebnih lastnih razmerij je zagotovo lastninska pravica. V diplomski nalogi je opredeljeno kako le-ta nastane in preneha, kakšne so njene omejitve ter sredstva zavarovanja. Drugi del diplomske naloge pa je namenjen posameznim večosebnim lastnim razmerjem. Najprej je opredeljena solastnina, nato etažna lastnina, za konec pa še skupna lastnina. Pri vseh treh oblikah je poudarek na njihovem nastanku ter upravičenjih, ki izhajajo iz njih.

Sekundarni povzetek: Multiparty owner relationships represent a special form of ownership. We're talking about the cases where a property is divided between several persons. There are two basic forms of multiparty owner relationships - joint ownership, and aggregate property. As a specific form of joint ownership, we must mention the floor ownership. An essential feature of multiparty owner relationships is the enforcement of proprietary rights belonging to more than one person. Joint ownership is a form of ownership, of which basic feature is the fact that the item is undivided and that entitlement of execution belongs to more persons in accordance with their ideal proportions. A specific form of joint ownership is floor ownership which distinguishes from joint ownership by dividing the item. The item in the floor ownership is divided physically and not just seemingly, into ideal proportions. Floor property represents unification of two different forms of property relationship, property relationship on individual parts of floor ownership and joint ownership relationship on common parts. The biggest difference between aggregate property and joint ownership is that the item in the aggregate property is not divided even into ideal parts. The aggregate property owners can manage the thing only altogether. The first part of the dissertation is based on the basics. I presented basic principles of real estate law and legal resources that are the foundation of editing multiparty owner relationships. I have given the greatest emphasis among the sources to Law of property code, which represent foundation for real estate arrangement. The distinction between the two terms is nowadays still a problem. The basis of multiparty owner relationships is certainly the ownership. In the dissertation I defined the way the ownership is formed and terminated and what are its limitations and means of insurance. The second part of the dissertation is dedicated to individual multiparty owner relationships. The first to be defined is joint ownership, floor ownership follows, and in conclusion the aggregate property. The emphasis in all three forms is on their formation and on entitlements arising from them.
