Povzetek
Trgovina z ljudmi predstavlja hud poseg v človekove pravice njenih žrtev. Med oblike izkoriščanja, ki se jih trgovina z ljudmi poslužuje, spada tudi prisilna poroka. Žrtve prisilne poroke so večinoma mladoletna ali mlada dekleta, ki se jih v skladu s tradicijo proda drugi družini, večinoma v zameno za denarno protivrednost. Po takšni poroki so dekleta zaradi podrejenega položaja, v katerem se znajdejo, zaradi neizkušenosti, mladosti ter neizobraženosti, pogosto žrtev nasilja. Nad njimi se izvaja klasično fizično nasilje, prihaja tudi do spolnih zlorab in zgodnjih nosečnosti. Zaradi svoje mladosti in nezadostnega dostopa do zdravstvene oskrbe so izpostavljene zdravstvenim tveganjem, ki jih prinaša nosečnost in nezmožnost izbire spolnih praks. Pogosto so prisiljene opravljati prisilna dela ter skrbeti za vsa domača opravila, zaradi česar nimajo prostega časa, prav tako pa je njihovo gibanje velikokrat omejeno in nadzorovano. Takšne poroke so bile obsojane s strani mednarodne skupnosti, ki poziva tudi k dvigu starostne meje za sklepanje zakonske zveze na 18 let starosti. Po ocenah mednarodne skupnosti so kršitve človekovih pravic, ki se dogajajo v okviru prisilnih porok, prehude, da bi se še lahko upravičevale s tradicijo in običaji skupin, v katerih se dogajajo. Takšne poroke se pojavljajo tudi na ozemlju Republike Slovenije, predvsem v romski skupnosti. Na podlagi relevantne sodne prakse Evropskega sodišča za človekove pravice je ugotovljena nujnost preiskovanja in odzivanja na prisilne poroke, da se prepreči poseg v človekove pravice, ki ga le te predstavljajo.

Human trafficking constitutes a serious breach of its victim’s human rights. A form of exploitation understood in the context of human trafficking is also forced marriage. Victims of forced marriage are most often underage or young girls that are sold for monetary benefits by their families, under the guise of tradition and customs. Once married, the girls often find themselves in a subordinate position to their husbands due to their age, lack of formal education and general inexperience. They become victims of violence, sexual abuse and early pregnancies. Due to their youth and what is often an insufficient health care, they are exposed to health risks that stem from early pregnancies and the inability to choose the form of their sexual practices. They are often forced into forced labor and domestic chores which leaves them little to no free time. Their movement and communication are also often restricted. Forced marriages have been deemed a violation of human rights by the international community and as such defending them on the basis of tradition is unfounded. There have also been initiatives to raise the age required to consent to marriage to 18 years. Forced marriage is a form of human trafficking that also takes place in Slovenia, mostly in the Roma community. To demonstrate the necessity of an appropriate response to forced marriage to ensure a proper protection of human rights, case law pertaining to human trafficking of The European Court of Human Rights is also reviewed. |
