Povzetek
Osnovni namen naloge je opredeljevanje prisilnega beračenja kot specifične oblike trgovine z ljudmi v smislu kriminološko zanimivega pojava v družbi. Naloga bo z analizo pisnih virov in pregledom pravne prakse ter v okviru izkušnje preučila možnosti učinkovitejšega dela policije in drugih državnih in nevladnih institucij na tem področju.
V diplomskem delu se predpostavlja, da pri sodobnih pojavnih oblikah beračenja ne gre za klasično beračenje, kjer posameznik zaradi različnih življenjskih okoliščin berači zaradi golega preživetja, temveč gre za obliko organiziranega kriminala. Posledično gre pri organiziranem prisilnem beračenju, kot specifični obliki trgovine z ljudmi za pojav ti. »sodobnega suženjstva«, v katero so posamezniki prisiljeni neposredno ali pa posredno in se v to podajo zaradi preživetja sebe in svojih družin.
V diplomskem delu se potrdi, da je bilo v Sloveniji v zadnjih letih obravnavanih več primerov kaznivih dejanj trgovine z ljudmi oziroma spravljanja v suženjsko razmerje, v povezi s prisilnim beračenjem. S tem se tudi potrdi, da Slovenija ni imuna na takšne pojave oziroma oblike kriminalitete. Predpostavlja se, da v Sloveniji zakonodaja omogoča učinkovito ukrepanje zoper organizatorje »sodobnega suženjstva«, da pa je preiskovanje takih primerov, zaradi različnih okoliščin, izredno zahtevno.
Prisilno beračenje, kot oblika modernega suženjstva, se v sodobni družbi še vedno preveč odriva na rob. Naloga je bila predstavitev prisilnega beračenja, kot specifične oblike trgovine z ljudmi, s pogledom lastne izkušnje. Tema ni odmevna v medijih, pojavljanje v njih je odvisno od posameznih primerov in zaznav avtorjev. Knjig in literature na to temo je malo, sogovornikov ni veliko. Pri delu so bile uporabljene metode deskripcije, kompilacije in metoda opazovanja z udeležbo.
Tujci, predvsem iz držav vzhodne Evrope, z organiziranim nedovoljenim beračenjem in s tem povezano kriminalno dejavnostjo (spravljanje v suženjsko razmerje in trgovino z ljudmi) so neredek pojav v Sloveniji. Osnovna ugotovitev na koncu diplomske naloge je, da primeri prisilnega beračenja kot specifične oblike trgovine z ljudmi dejansko obstajajo.

The main purpose of this diploma paper is the definition of forced begging as specific form of human trafficking in terms of criminological interesting phenomenon in society. In my diploma paper I will analyze the literature review as well as the legal action and the experience of examining the possibility of more efficient work of the police and other governmental and non-governmental institutions.
In my diploma paper, it is assumed that the modern form of begging is not a classical begging, where an individual due to different life circumstances begins to beg out of sheer survival, but it is a form of organized crime. Consequently, the organized forced begging can lead to specific form of human trafficking and later on to "modern slavery" to which individuals are forced to either directly or indirectly to this pass because the survival of themselves and their families.
This diploma paper confirms that in recent years Slovenia has dealt with several cases of crimes connected to human trafficking and human slavery, which evolved from forced begging. This also confirms that Slovenia is not immune to such a phenomenon and this form of crime. It is assumed that in Slovenia, the law allows effective action against the organizers of "modern slavery", however the investigation of such cases is extremely challenging, due to various circumstances.
In modern society the phenomenon of forced begging as a form of modern slavery is still too sidelined. The task was to present forced begging as a specific form of human trafficking, with a view of my own experience. The topic of begging is not present in the media however it depends on the individual case and the author's perceptions. There are few books and literature on this topic. As a method I used a descriptive method, compilations and method of participant observation.
Foreigners, mainly from Eastern Europe, organized illegal begging and related criminal activity (which can lead to modern slavery and human trafficking) and this is not a rear phenomenon in Slovenia. The basic finding at the end of my diploma paper is, that the examples of forced begging as a specific form of human trafficking actually exists. |
