Povzetek
V diplomski nalogi je obdelano eno od področij delavčeve zasebnosti in sicer varstvo osebnih podatkov.
V uvodnem delu je prikazana umestitev pravice do varstva osebnih podatkov v širši sistem pravice do zasebnosti ter pojasnjeni nekateri osnovni pojmi obravnavanega področja, kot so osebnostne pravice, zasebnost, pravica do zasebnosti, informacijska zasebnost, varstvo osebnih podatkov.
Namen tega pisanja je celovito predstaviti ureditev varstva osebnih podatkov delavca tako na mednarodni kot na nacionalni ravni. Cilj razmišljanja je ugotoviti, ali je slovenska ureditev omenjenega področja ustrezna.
Poudarek je na pravicah in dolžnostih delodajalca kot upravljavca osebnih podatkov ter na varstvu osebnih podatkov delavcev pri obdelovanju njihovih podatkov, ki izhaja iz zakonodaje.
V nadaljevanju naloge je obravnavanje različnih tehnoloških sredstev nadzora in s tem pridobivanja osebnih podatkov, katerih uporaba narašča. V okviru tega je obravnavano področje video nadzora, biometrije ter pametnih kartic.
V diplomski nalogi so nadalje navedeni zahtevki s katerimi razpolaga posameznik oziroma delavec v zvezi z varstvom osebnih podatkov.
Predstavljen je tudi nadzor nad spoštovanjem določb, ki urejajo varstvo osebnih podatkov na delovnem mestu.
Na koncu diplomskega dela sledi še kratek prikaz ureditve varovanja zasebnosti in osebnih podatkov v Združenih državah Amerike, Kanadi in Zvezni republiki Nemčiji.
V zaključku se ugotavlja, da je nacionalna zakonodajna ureditev problematike varstva osebnih podatkov ustrezno usklajena z zavezujočo mednarodno ureditvijo, sodobna in napredna ter ustrezno ščiti pravice delavca. Vendar pa področje osebnih podatkov kot tudi širše zasebnosti v delovnem pravu ni urejeno sistematično, ampak s področno zakonodajo, zato lahko prihaja do kolizije med zakoni in posledično do pravnih praznin. Smotrno bi bilo sprejeti poseben zakon, ki bi samostojno urejal zasebnost na delovnem mestu.

In the following diploma work the main focus is on the worker's privacy and that is the field of protection of personal data.
In the introduction the placing of the right of protection of personal data in broader system of privacy is described and some basic terms are explained like for example personal data, privacy, the right to privacy, information privacy, protection of personal data.
The main purpose of the following diploma work is to present the legal regulation of worker's protection of the personal data on the international and national level. The goal is to find out whether the Slovenian legal regulation of the mentioned field is appropriate.
The emphasis is on the rights and obligations of employer as the operator of personal data and on protection of worker's personal data by analyzing them as indicated by law.
In the prosecution of the diploma work we find different technological means of control which help gaining personal data (their use is increasing). Within this framework the field of video control, biometry and smart cards is described.
In the following chapters are also stated some claims with which an individual or worker can dispose in conection with protection of personal data.
Presented is also the control over compliance with the provisions which manage protection of personal data at the workplace.
At the end of the diploma work there is a rewiev of regulation of protection of the privacy and personal data in United states of America, Canada and the Federal Republic of Germany.
In the conclusion we can see that the national legislative regulation of protection of personal data is harmonized with the bonding international legal regulation. It is modern, up to date and protects the worker's rights due to the legislative. However the field of protection of personal data as well as broader privacy in the working law is not ordered systematically but with relevant legislation and therefore it may come to a conflict between the laws and consecutively to a legal vacuum. It would be reasonable to adopt a special law which would independently from other laws manage privacy at the workplace. |
