Povzetek

Uvodoma so predstavljeni pojmi s katerimi sem se najpogosteje srečala ob branju literature in drugih virov nanašajoč se na dotični predmet raziskovanja t.j. ugovor vesti v zdravstvu v Republiki Sloveniji. V nadaljevanju sem se posvetila zgodovinskemu aspektu ugovora vesti t. j. kako je ugovor vesti postal ena izmed ustavno priznanih temeljnih človekovih pravic v sistemu zdravstva oziroma se je razvijal do te stopnje tako na mednarodni ravni kot tudi na nacionalni ravni. Podana in pojasnjena je pozitivna zakonodaja v Republiki Sloveniji, ki umešča ugovor vesti kot pravico v zdravstvenem sistemu. Predstavljen je tudi postopek uveljavljanja dotične pravice in pa njena problematičnost glede na konflikt interesov med posameznimi subjekti. V diplomski nalogi je obravnavana ureditev uveljavljanja ugovora vesti na posameznih področjih zdravstva, ki izhaja iz poklicnoetičnih kodeksov. Izpostavljeni so primeri medicinskih posegov na posameznih zdravstvenih področjih, kjer se najbolj pogosto udejanja pravica do ugovora vesti. V sklepu so podane ugotovitve, da je pravica do ugovora vesti v zdravstvu v konfliktu s pravico do zdravstvenega varstva in da je v slovenski zakonodaji določena relativno ohlapno, vendar dovolj določno, da se jo lahko zagotavlja. Institut je urejen tako v Ustavi RS kot v področnih zakonih in drugih predpisih. Predstavljene so tudi rešitve, ki bi morda odpravile problematiko uporabe ugovora vesti.

Sekundarni povzetek: In my thesis I present the concepts, which are most often used in the literature about the subject of research, this is Conscientious objection in the health care system in the Republic of Slovenia. The fact that the conscientious objection in the health system is a delicate topic, especially because of the very different and conflicting ethical views, I focused to determine how conscientious objection is arranged in health care systems. I focused on the historical aspect of conscientious objection and how it became one of the constitutional human rights in the health care systems at the international level as well as at the national level. In my thesis I am explaining the positive law of the Republic of Slovenia, which places the conscientious objection as a legal right in the health care system. In continuation, I describe the procedure of exercising this right and I discuss the problems about its use because of the conflict interest between the individual entities. In the thesis I discuss the (none) regulation of the exercise of conscientious objection in specific areas of the health care system arising from professional code of ethics. In continuation are described the most common examples of medical interventions on individual parts of health care systems, where they practice the right of conscientious objection. In the conclusion are the findings that the right of conscientious objection in the health care system is in conflict with the right to a health care. In the Slovenian legislation provides a relatively loosely, but sufficiently precise that it can provide. This Institute is formally regulated in the Constitution and in the specific laws and other regulations in the Slovenian legislation. In the conclusion I also presented the solutions that might eliminate the problem of the use of conscientious objection.
