Povzetek

Zapor je ustanova, v kateri so zaprte osebe, ki so bile obsojene zaradi storjenega kaznivega dejanja, s katerim so ogrozile varnost družbe in države. Cilji zaporne kazni so kaznovanje, zastraševanje, resocializacija, onesposobitev storilca ter zaščita družbe in države. Obsojenci imajo na prestajanju kazni določene pravice ter ugodnosti, za katere pa javnost meni, da si jih ne zaslužijo. Ko gredo ''nevarni ljudje'' v zapore, je javnost zadovoljna, saj se tako počuti varneje in meni, da je to najboljša obramba pred kriminaliteto. Družba velikokrat zavode za prestajanje kazni zapora primerja s hoteli. Svobodni si težko predstavljamo, kako je, ko ti odvzamejo pravico do svobode, ko se moraš podrejati določenim pravilom, ko si prisiljen živeti s toliko različnimi ljudmi in še bi lahko naštevali. S tem diplomskim delom skušamo predstaviti pravice obsojencev med prestajanjem zaporne kazni v slovenskih zaporih in ugotoviti mnenje ljudi o izbrani temi. V teoretičnem delu je predstavljenih nekaj splošnih dejstev o zaporih, o življenju obsojencev, njihovih pravicah, o namenu in kritiki zaporne kazni. V raziskovalnem delu diplomske naloge smo ugotavljali seznanjenost javnosti s pravicami in ugodnostmi obsojencev na prestajanju zaporne kazni ter njihovo mnenje o pravicah obsojencev. Rezultati so nas presenetili. Glede na dobljene odgovore smo ugotovili, da javnost meni, da je dobro seznanjena s pravicami in ugodnostmi obsojencev, da jim je naklonjena in ne verjame, da je izločitev in odstranitev obsojenca iz družbe najboljša obramba pred kriminaliteto. Le na dve vprašanji so anketiranci odgovorili v skladu s postavljenimi hipotezami; javnost se počuti varneje, ko gredo nevarni ljudje v zapore, ter meni, da obsojencem na prestajanju kazni zapora ''ni hudega''. Upoštevati pa moramo dejstvo, da bi bili rezultati po vsej verjetnosti drugačni, če bi si izbrali večji vzorec respondentov.

Sekundarni povzetek: A prison is an institution where they keep people who were sentenced for a crime they committed that put the safety of society and the country at risk. The goals of a prison are to punish, intimidate, resocialise and disable the offender and protect society and the state. Prisoners serving prison sentences have certain rights and benefits, which the public feels they do not deserve. When ‘dangerous people’ go to prison, the public is satisfied because it feels safe and is of the opinion that this is the best defence against crime. The public often compare imprisonment with staying at a hotel. Free people find it hard to imagine what life is like with the basic right of freedom taken away from you, having to obey certain rules, being forced to live with a number of different people and so on. Bachelor thesis attempts to present the convicts’ rights during imprisonment in Slovenian prisons and tries to get the public’s opinion on this topic. The theoretical part presents some general facts about prisons, prison life, the rights of prisoners, the purpose and criticism of imprisonment. The practical part of the thesis tries to establish the public’s familiarity with the rights and benefits of the prisoners serving a prison sentence and the public’s opinion on the rights of prisoners. The results were surprising. The answers revealed that the public is quite familiar with the prisoners’ rights and benefits, is favourable towards them and is not of the opinion that the isolation of prisoners from society is the best defence against crime. Only two questions were answered according to our expectations and the set hypotheses; the public feel safer when dangerous people go to prison and is of the opinion that the prisoners serving a prison sentence ‘have it easy’. We have to take into account that the results probably would have been different if we had a larger sample of respondents.
