Povzetek
Hipoteka kot oblika zastavne pravice na nepremičninah je ena izmed pomembnejših oblik zastavnih pravic, ki jih ureja Stvarnopravni zakonik, ki je stopil v veljavo 1. januarja 2003. Stvarnopravni zakonik ureja predvsem materialnopravno ureditev hipoteke, postopkovna pravila pri realizaciji hipotekarnega zavarovanja pa so urejena v Zakonu o izvršbi in zavarovanju, kjer je z avgustom letos pričela veljati novela K (Uradni list RS, št. 54/2015 ), ki ponovno prinaša nekaj sprememb na področju izvršbe. V postopku stečaja pa so za hipotekarnega upnika upoštevne določbe Zakona o finančnem poslovanju, postopkih zaradi insolventnosti in prisilnem prenehanju, ki je zadnjo (šesto) spremembo doživel leta 2013 z novelo F (Uradni list RS, št. 100/13). Ker je hipoteka tipična knjižna pravica, katere vpis je v večini primerov konstitutivne narave, je najbolj pomemben zakon na tem področju Zakon o zemljiški knjigi, ki ureja temelje vknjižbe hipotekarnega zavarovanja v zemljiško knjigo. Namen mojega diplomskega dela je predstaviti hipotekarno zavarovanje v čim bolj strnjeni obliki, saj je tematika zelo široka. Poskušala sem izpostaviti najbolj pomembne vidike in lastnosti hipotekarnega zavarovanja kot sredstva za varstvo upnika v pravnem prometu.
Diplomsko delo je razdeljeno na devet okvirnih poglavij. V začetnih poglavjih sem poskušala na kratko predstaviti funkcijo hipoteke in temeljna načela hipotekarnega prava, ki so, kot lahko vidimo, izjemno pomembna tudi pri odločanju v sporih na tem (hipotekarnem) področju. V nadaljevanju nekaj besed namenjam samemu nastanku hipoteke, torej kaj hipoteka kot oblika zavarovanja obsega, prav tako pa sem na kratko predstavila še posebne oblike hipoteke. Največ pozornosti sem posvetila realizaciji hipoteke in kako mora hipotekarni upnik postopati, če želi dobiti poplačilo svoje zapadle terjatve, in kako poteka sama prodaja zastavljene nepremičnine. Nekaj besed sem namenila tudi zunajsodni prodaji nepremičnine preko notarja, katere izvajanje pa je pri nas do nadaljnjega (žal) še zadržano. V zadnjem delu diplomskega dela sem predstavila še načine prenosa hipoteke ter na samem koncu še prenehanje hipoteke zaradi različnih razlogov. V celotnem diplomskem delu so v primerjavo podani relevantni primeri tako iz starejše kot tudi aktualne sodne prakse. V sklepu na kratko povzemam svoje mnenje glede opisane tematike in izpostavljam nekaj problemov, ki so se mi izpostavili ob preučevanju sodne prakse.

Mortgage, as a form of a lien on the immovable property, is one of most valued forms of liens, regulated by the Property Code that started to apply on January 1st, 2003. Property Code regulates mostly substantive regulation of mortgage. Procedural rules are regulated in Execution and insurance Code with the latest, K amendment in august 2015. This amendment initiates few changes on the field of execution. When a debtor is in a bankruptcy procedure, the mortgagee uses The Financial Operations, Insolvency Proceedings and Compulsory Dissolution Act for his course of action. This Act had its latest amendment F in the year 2013. For mortgage being a typical scriptural right, with its entry being in most cases a constitutive nature, the most important act regulating this area is Land Registry Act, which regulates the foundations of registering of mortgage insurance in the public land register, that provides the necessary publicity of this right. The purpose of my thesis is to introduce mortgage insurance in the most concise form because the topic itself is very wide. And therefore I tried to summarize the most important aspects and characteristics of mortgage insurance, for a creditor to use it as an asset in legal transactions.
I divided my thesis into nine sections. Initially, I tried to briefly explain the basic function of mortgage insurance in its basic principles of mortgage law, that are, as we can see, very important when ruling in the court proceedings that occur in this field of law. Hereafter I'm noting a few words to the mortgage formations, particularly about the scope that mortgage has and a few different forms of mortgage. The most important part of my thesis is definitely dedicated to creditors and the way of getting their repayment with mortgage realization by selling the insured property. I am also mentioning an »out of court« sale of property, but (unfortunately) not yet functioning on our grounds. In the final part of my thesis I tried to introduce different ways of mortgage transfers and in the very end some words about finalising the mortgage itself for various reasons. During my entire thesis I cross compared relevant law cases found both in older and in topical case law. In my thesis conclusion, I summarized my opinion referring to discussed topics, that occurred during my case law study. |
