Povzetek
Kaj je pravzaprav korupcija? »Po najpreprostejši razlagi, ki jo lahko izpeljemo iz zakonske definicije, gre za vsako kršitev dolžnega ravnanja, z namenom pridobiti korist zase ali za drugega. Zakon o integriteti in preprečevanju korupcije jo definira kot: "Vsaka kršitev dolžnega ravnanja uradnih in odgovornih oseb v javnem ali zasebnem sektorju, kot tudi ravnanje oseb, ki so pobudniki kršitev ali oseb, ki se s kršitvijo lahko okoristijo, zaradi neposredno ali posredno obljubljene, ponujene ali dane oziroma zahtevane, sprejete ali pričakovane koristi zase ali za drugega."
Korupcija predstavlja perečo temo in problem za vse države na svetu. Tesno je povezana z organiziranim kriminalom, kriminalnimi skupinami ter s samim gospodarskim kriminalom oziroma samo kriminaliteto t. i. belih ovratnikov. Je velika grožnja in ogroža temelje demokracije v demokratičnih sistemih ter negativno vpliva na državo in njene državljane.
O pojavu korupcije v Republiki Sloveniji lahko zadnjih nekaj let slišimo ogromno. Od kaznivih dejanj sprejemanja in dajanja daril, jemanja ali dajanja podkupnine, podkupnine pri volitvah ali od daleč najbolj odmevne korupcije v letu 2014, pravnomočne obsodbe v primeru Patria, nekdanjega premierja Republike Slovenije Ivana Janeza Janše.
Vendar pa bi morali korupcijo dojemati širše. »Novo« in trenutno najbolj uporabljeno definicijo korupcije je doprinesel Zakon o preprečevanju korupcije, ki je bil sprejet v letu 2004. Seveda pa le-to definicijo vsebuje tudi sedaj veljavni Zakon o integriteti in preprečevanju korupcije (2010), ki korupcijo definira kot vsako kršitev dolžnega ravnanja uradnih oziroma odgovornih oseb v javnem ali zasebnem sektorju, kot tudi ravnanje oseb, ki so pobudniki kršitev, ali oseb, ki se lahko s kršitvijo okoristijo, zaradi neposredno ali posredno obljubljene, ponujene ali dane oziroma zahtevane, sprejete ali pričakovane koristi zase ali za drugega.

What exactly is corruption? "The simplest interpretation according to its definition of the law, it goes for any breach of duty in order to obtain a benefit for himself or for another. The law of integrity and prevention of corruption is defined as: "Any violation of duty of official and responsible persons in the public or private sectors, as well as the conduct? of persons who are the initiators of the offense? or persons who are in breach may avail themselves due to directly or indirectly promised, offered or given,or moreover requested, accepted or expected benefit for himself or for another ''
Corruption represents a very pressing, tabu topic and problem for countries all over the world. It is closely connected to organized crime, criminal groups and also to economic crime or to white collar crime itself. It is a big threat and endangers/puts in danger? the foundations of democracy in democratic systems and it's leaving negative impact on the country and the citizens of the country themselves.
We've heard a lot on the occurrence of corruption in the Republic of Slovenia in the last couple of years . From the offenses of giving and taking gifts, receiving or giving bribes, bribes at elections to far the most high-profile corruption in 2014, a final conviction in the case of Patria, former Prime Minister of the Republic of Slovenia Ivan Janez Janša.
However, we should all try to understand corruption more widely. To the ''new" and currently the most widely used definition of corruption contributed the Prevention of Corruption Act, which was adopted in 2004. However, this definition is also included in the currently valid Law on Integrity and Prevention of Corruption (2010), which defines corruption as any violation of duty of official or responsible person in the public or private sectors, as well as the conduct of persons who are the initiators of the violation?, or persons who may avail of the breach due to directly or indirectly promised, offered or given or requested, accepted or expected benefit for himself or for second. |
