Povzetek

Najemna razmerja za stanovanja in poslovne prostore so v današnjem času nekaj povsem običajnega. Marsikdo se je namreč že srečal z najemno pogodbo, pa naj bo to v vlogi najemodajalca ali najemnika. Stanovanjski in poslovni prostori, ki se pri tem dajejo v najem, so v bistvu posamezni deli določene zgradbe, lastnina na teh posameznih delih pa skupaj s solastnino na skupnih delih predstavlja etažno lastnino. Etažna lastnina je posebna oblika lastninske pojavnosti, ki se pri nas pojavlja vse od petdesetih let prejšnjega stoletja. Podrobno jo ureja Stvarnopravni zakonik. Pomembni za nastanek, vpis in najem etažne lastnine pa so tudi drugi zakoni. Namen diplomske naloge je predstaviti predmet etažne lastnine in njen najem. Od tega, kako je posamezen del etažne lastnine oblikovan, je odvisna uporaba zakonodaje, ki ureja določeno najemno razmerje. Tako se za posamezen del, ki je oblikovan kot stanovanje, uporabi Stanovanjski zakon, medtem ko se za poslovne prostore uporabi Zakon o poslovnih stavbah in poslovnih prostorih. Zakona, ki izhajata iz enotne ureditve etažne lastnine, nadalje precej različno urejata najemna razmerja. Zato bom v diplomskem delu predstavila bistvene razlike med najemom stanovanjskih in poslovnih prostorov ter nekaj primerov iz sodne prakse. Od leta 2013 je obvezno tudi poročanje v evidenco trga nepremičnin o sklenjenih najemnih pogodbah, zato sem v diplomski nalogi predstavila postopek poročanja ter statistiko sklepanja najemnih pogodb za zadnja leta. Pri sklepanju najemnih pogodb za stanovanja in poslovne prostore gre za trajnejša najemna razmerja med vsaj dvema strankama, zato je bistvenega pomena, da jim posvetimo dovolj pozornosti ter upoštevamo vse zakonske določbe, ki so kogentne narave.

Sekundarni povzetek: Tenancy relationships for residential as well as commercial properties are commonplace in present times. Many a person has met with a tenancy agreement whether in a role of a lesser or a tenant. Residential and commercial properties available for lease are defined as single units of a certain building. Property of these single units together with joint ownership of the shared parts constitutes the floor ownership. The floor ownership represents a specialized type of tenure that has been present in our country in the last fifty years. It is subject of regulation by the Law of Property Code. Related laws are also significant for the origin, enlistment and rent of the floor agreement. The thesis focuses on the subject of the floor agreement and its lease. Formation of the individual part of the floor agreement dictates the use of legislation that regulates explicit tenancy agreements. Therefore, the Housing Act regulates the area intended for dwelling, while the commercial premises are subject of regulation by the Law of Office Buildings and Commercial Premises. Despite the fact that these laws result from the unified floor agreement regularisation, the tenancy agreements that are subject to their regulation differ substantially further on. For that reason, the thesis tries to illustrate the main disparities between residential and commercial tenancy and its legal application. The thesis introduces the reporting procedure and the statistics of the tenancy agreements concluded in the last few years. Reporting on concluded tenancy agreements to the real estate market records became mandatory in 2013. As entering into tenancy agreements for residential and commercial property is a matter of lasting tenancy relationship between at least two clients, it is of substantial importance that it receives sufficient attention and that all mandatory legislative provisions are taken into consideration.
