Povzetek

Do pojava mednarodne starševske ugrabitve otroka pride v trenutku, ko en od staršev otroka protipravno odpelje v tujino oz. ga protipravno zadržuje v tujini, in na ta način ne samo krši pravico drugega starša do varstva, vzgoje in stikov s skupnim otrokom, ampak obenem krši tudi pravico otroka do osebnega odnosa in stikov z obema staršema. Ena pomembnejših pravic vsakega otroka je namreč prav pravica živet s svojimi starši, poleg tega pa je tudi starševska skrb, razen izjemoma, pravica in dolžnost obeh staršev, tako matere kot očeta in jo morata izvrševati oba. Družina je ne samo osnovna celica družbe, ampak tudi pomemben družbeni sistem, njene glavne funkcije pa poleg biološke, tudi psihološka in sociološka, kar je še posebej občutljivo v povezavi s varovanjem otrokovih pravic.

Sekundarni povzetek: The phenomenon of the international parental child abduction happens in the moment, when one of the parents »kidnaps« the child in common, that means s/he wrongfully removes the child from the family environment and takes the child to a foreign country or s/he wrongfully retains the child in a foreign country. When this happens it's not only a matter of a violation of the right of the other parent to take care and to protect the child in common, but it's also a violation of the child's right to have a personal relationship and contact with both parents. One of the most important rights of the child is the right to live with his parents, but the issue is not only this. The parental responsibility and care is, unless in exceptional cases, the right and duty of both parents, the mother and the father, and must be therefore performed together. Family is not only the basic unit of the society, but it is also a important society system, whose major functions are not only biological, but also psychological and sociological, which is an especially delicate topic when it comes to the protection of the child's right.
