Povzetek
Zemljiška knjiga, kot javna evidenca, ki služi prikazu pravnega stanja v zvezi z nepremičninami, je prav gotovo, zaradi te svoje temeljne funkcije, nepogrešljiva za nepremičninski pravni promet, s tem v zvezi pa tudi za zagotavljanje ustrezne pravne varnosti vseh udeležencev nepremičninskega trga. Nesporno je, da le urejena zemljiška knjiga, ki daje pravilen zemljiškoknjižni prikaz dejanskega stanja, lahko služi svojemu namenu, vendar kljub temu si danes, glede na obsoječi pravni sistem, ki konceptualno jasno opredeljuje stvarnopravne in zemljiškoknjižne institute, kar težko predstavljamo, da funkcioniranje zemljiške knjige ni takšno kot bi sicer moralo biti in kot je glede na obstoječo pravno ureditev pričakovano.
Dejstvo je, da zdajšnji pravni ureditvi neusklajenost zemljiškoknjižnih stanj z dejanskim stanjem ni tuja. Razlogi za takšno stanje, ki kot rečeno »načenja« pravno varnost in pomeni tveganje za posameznikove pravice, so različni. Pri nekaterih posameznikih (čeprav so takšni primeri verjetno redki) je še vedno prisotna miselnost iz prejšnjega družbenolastninskega sistema, ko se zemljiškoknjižnim vpisom ni pripisovalo večjega pomena. Nadalje so v praksi pogosti primeri, ko posameznik ne razpolaga s formalno popolno listino, primerno za izvedbo zemljiškoknjižnega vpisa, takšna listina je velikokrat bodisi uničena, poškodovana, tudi izgubljena, pogosto pa ni opremljena z zemljiškoknjižnim dovolilom ali pa podpis na takšnem dovolilu ni notarsko overjen. Poglaviten razlog takšnega nevzdržnega stanja na nepremičninskem področju pa je prav gotovo zapuščina preteklega sistema, ko so številni zapleti nastali še v času preoblikovanja družbene lastnine v klasično obliko lastnine. Pravni položaj številnih nepremičnin je v postopkih transformacije še danes ostal zemljiškoknjižno neurejen, kar je zlasti problem na področju etažnolastninskih razmerij. Nesporno je, da se zakonodajalec zaveda nastale problematike, saj si je in si ves ta čas prizadeva z različnimi (bolj ali manj uspešnimi) ukrepi sanirati nastalo stanje.

The land register as a public record, which serves to indicate the legal situation with regard to real estate, and is, due to its core functions, undoubtedly essential to real estate legal transactions, as well as to providing adequate legal certainty for all participants in the real estate market. It is indisputable that only the regulated land register, which gives a proper land registry display of the facts of the case, can serve its purpose. Nevertheless, today, it is difficult to imagine that the functioning of the land register is not as it is supposed to be, and as it should be according to the existing legislation.
The fact is that the mismatch between the situation of the land registry and the actual situation is not foreign to the current legislative regulation. The reasons for this situation, which "erodes" legal security and poses a risk to the rights of the individual, are different. With some individuals (although such cases are probably rare) the mentality of the previous social property system is still present, when the entry in the land registry was not attributed greater importance. Furthermore, there are frequent cases when an individual does not have a formally complete document to perform the land register entry; such a document is often either destroyed, damaged, even lost, and is often not equipped with the land register permit or the signature on the permit is not notarized. The main reason for such an unsustainable situation in the real estate sector is certainly a legacy of the previous system, when many complications arose during the transformation of social property to the classical form of property. The legal position of a number of real estate in the processes of transformation has still remained unregulated in the land registry, which is particularly a problem for commonhold unit relationships. It is undisputed that the legislator is aware of these problems, because it is still striving to solve them by applying different (more or less successful) measures to remedy the resulting situation. |
