Povzetek
Distribucija toplote ali tudi daljinsko ogrevanje je v Sloveniji določeno kot gospodarska javna služba. Na območjih, kjer se izvaja, za izvajalca javne službe, lastnike in najemnike velja dolžnost sklenitve pogodbe o dobavi toplote, oziroma dolžnost izvajanja in uporabe organzirane javne službe. Pomembna značilnost predmetne javne službe je tudi nemožnost odklopa posameznega stanovanja v skupnih sistemih ogrevanja večstanovanjskih stavb in predpisana delitev skupnih stroškov, ki ne omogoča izvzetja posameznega lastnika ali najemnika iz participacije v skupnih stroških. V takšnem sistemu je zato izjemnega pomena zakonska opredelitev odgovornosti lastnikov za neplačane stroške najemnikov. Takšne določbe namreč bolj pravično porazdeljujejo rizik neplačil najemnikov, ki bi ga sicer morali nositi ostali uporabniki javne službe, preko povišane cene javne službe zaradi odpisov. Ne glede na izrecne določbe slovenskih normativnih aktov, pa se pri uveljavljanju teh določb v praksi izvajalci javnih služb srečujejo s težavami. Glavna tema magistrskega dela je tako predstaviti slovenske pravne podlage odgovornosti lastnikov, sodno prakso in še vedno odprta vprašanja, zlasti pri uveljavljanju odgovornosti lastnikov neprofitnih stanovanj v večstanovanjskih stavbah. Bistveno vprašanje pri tem je, ali vse te pravne podlage predstavljajo zakonito poroštvo in posledično ugodnejšo obravnavo terjatev glede zastaranja proti lastnikom. Kot se je v praksi izkazalo, je izključevanje lastnikov neprofitnih stanovanj iz zakonsko določene odgovornosti lastnikov povzročilo neskrbnost pri odpovedovanju pogodb, s tem pa se pojavlja vprašanje učinkovitosti nadzora nad izpolnjevanjem pogojev za tovrstne socialne pravice. Postavlja pa se tudi vprašanje primernosti politike socialne zakonodaje, saj so se namesto transparentno in nadziranega postopka izplačil iz javnih sredstev stroški socialno ogroženih kopičili pri izvajalcih javnih služb. Iz navedenih težav se je potrebno učiti in tudi vnaprej paziti pri sprejemanju ukrepov, ki bi ponovno omogočili tovrstno prakso. Posebna problematika pa je tudi položaj izvajalcev javnih služb v postopkih insolventnosti.

Difficulties in resolving debts of district heating |

District heating in Slovenia is defined as a public service. In areas where district heating is regularly performed, the public service provider, the owner and the tenant of the building have a duty to conclude contracts relating to the provision of public service. In addition, the essential characteristic of district heating in multi-apartment buildings is the fact, that just one of the apartments can not be disconnected from the common heating system (real estate central heat supply). There are also rules on the sharing of common costs , which do not allow the exclusion of an individual owner or tenant. In such system it is therefore very important issue liability of owners for the unpaid costs of tenants. This kind of provision in legislation more equitably distributes the risk of non payment, that would otherwise remain on the other users, because of the elevated price of public service, due to write-offs of the debts. However, in spite of explicit provisions in Slovenian legislation, a gap still remains between the applicable legal rules and the reality confronting public service providers, when they seek to exercise this right in practice. The main theme of the master's degree is therfore to introduce various Slovenian legal bases for enforcing liability of owners, Slovenian court's case law and remaining issues, especially concerning liability of owners of non-profitable apartments in multi-apartment buildings. The essential question is whether all of those legal bases can be classified as as suretyship, and consequently more favorable treatment on limitation of claims against the owners should apply. As practice has shown, the exclusion of non-profit housing owners from legal liability of owners resulted in carelessness at terminations of lease contracts, which in turn raises the question of the effectiveness of supervision over the fulfillment of the conditions for this kind of social rights. The question is also a question of the appropriateness of the policy of social legislation, because instead of a transparent and controlled administrative procedure for granting additional financial help for payments of heating from public funds, the costs of socially disadvantaged accumulated at public service providers. It is necessary to learn from mentioned problems, and continue to take care not to adopt similar measures, that would allow such practices again. Another special issue is the position of public service providers in the insolvency proceedings. |
