Povzetek

Evtanazija je pojem, ki posega prav na vsa družbena področja. Odraža odnos posameznika in družbe do temeljnih vprašanj vsake civilizacije, kot so spoštovanje človekovega življenja, dostojanstva, svobode, avtonomije. Nanaša se na enega izmed najtežjih obdobjih v življenju vsakega posameznika, na umiranje oziroma na odločitev o končanju življenja. Zaradi tega je po eni strani tesno povezano s posameznikom samim in na drugi strani s celotno družbo. Kot takšno že skozi celotno zgodovino človeštva postavlja in premika meje, do kod je poseg družbe v to najtežje obdobje vsakega posameznika upravičen. Ali sploh je upravičen? To vprašanje si kot družbena veda seveda postavlja tudi pravo. Prav pravo ima pri tem odločilno vlogo, saj s svojimi pravili ureja in regulira temeljne odnose v družbi ter ščiti temeljne vrednote. V kazenskem pravu je človekovo življenje postavljeno v sam vrh zavarovanih vrednot in za poseganje v to vrednoto so predvidene stroge sankcije. Zato je (kazensko) pravo tesno povezano s problematiko evtanazije in vseh vprašanj, povezanih z njo. Zdi se, da se v sodobni družbi vedno bolj poudarja posameznikova avtonomija, svoboda in neodvisnost od drugih. Vsak želi v kar največji možni meri sam razpolagati s svojim življenjem in upravljati z njim, biti gospodar svojega življenja. To se izrazito kaže tudi pri odločitvah, povezanih s končanjem življenja. Vse bolj pogosto smo priča situacijam, ko si posameznik želi imeti pod nadzorom tudi svoje umiranje ter odločiti o tem, kdaj in kako si želi umreti. Razlog za takšno odločitev so največkrat hude neozdravljive bolezni in starostne težave. Problem pri tem je, da takšna odločitev ni povezana le s posameznikom, pač pa s celotno družbo. Interes posameznika trči ob interes družbe, in postavi se vprašanje, kje med njima potegniti mejo. Namen te diplomske naloge je predvsem prikazati, kako kolizijo teh dveh interesov rešuje (kazensko) pravo.

Sekundarni povzetek: Euthanasia is a concept which affects all areas of society. It reflects the relation of the individual and society to the fundamental questions of every civilization, such as respect for human life, dignity, liberty, autonomy. It touches one of the most difficult periods in the life of every individual - death and the decision to terminate life. For this reason is closely related to the individuals themselves on the one hand and to the entire society on the other hand. As such, throughout the entire history of mankind it sets and moves the limits of how far the intervention of society in the most difficult period of each individual is entitled. Is it entitled at all? This question is also related to the law as a social science. Also, the law has crucial role in this, as with its rules governs and regulates the fundamental relations in society and protecting fundamental values. In criminal law, human life is raised to the top of insured values and for intervention in this value are provided severe sanctions. Therefore, the (criminal) law is closely related to the issue of euthanasia and all issues related to it. It seems that modern society increasingly emphasizes the autonomy of the individual, freedom and independence from others. Everyone wants to dispose with his own life and to manage with it as far as possible, to be master of his own life. This is highly reflected also in decisions related to the termination of life. Increasingly we are seeing situations where individual wants to have control over his dying and where he wants to take a decision about when and how he wants to die. The reason for this decision are usually serious incurable diseases and age problems. The problem with this is that such a decision is not related only to individuals but to society as a whole. Interest of the individual collides with the interests of society, and the question is, where to draw the line between them. The purpose of this thesis is mainly to show how (criminal) law solves the conflicts between these two interests.
