Povzetek

Kupčevi temeljni obveznosti po CISG sta plačilo kupnine in prevzem blaga in sta kot taki določeni v 53. členu CISG. Vendar pa ima lahko kupec tudi druge (tj. dodatne obveznosti), če sta se stranki zanje dogovorili v pogodbi. Teh konvencija sicer ne ureja, ampak le predvideva možnost dogovora strank o tem. Obveznosti plačila kupnine je v CISG namenjeno kar šest členov in je tako zelo podrobno urejena. CISG tako ureja problematiko vsebine same obveznosti plačila in jo tako v 54. členu podrobneje opredeljuje. Nadalje se posveča tudi primeru nedoločene ali nedoločljive cene in to ureja v 55. členu. V 57. členu se CISG posveča kraju plačila kupnine, v 58. členu pa času plačila kupnine. V 59. členu razrešuje dilemo o zahtevi za plačilo in določa, da zahteva za plačilo ni pogoj za dospelost. Prevzem dobave je urejen le v enem členu, ki to obveznost podrobneje opredeljuje. Pravna sredstva prodajalca so urejena v členih od 61 do 65. CISG. V 61. členu so našteta pravna sredstva, ki jih ima prodajalec na voljo. Ob branju te določbe lahko dobimo vtis, da je uporaba sredstva mogoča ne glede na vrsto kršitve, vendar pa 64. člen vsebuje posebni ureditvi za kršitev obveznosti plačila ali kršitev obveznosti prevzema, 65. člen pa ureja posebno pravno sredstvo pri prodaji s specifikacijo.

Sekundarni povzetek: Buyer's fundamental obligations under the United Nations Convention on Contracts for the International Sale of Goods (CISG) are payment of the price and taking over the delivery. These two requirements are defined in the 53rd article of the CISG. However the consumer may have other (i.e. additional obligations) as well if the clients have agreed upon them in the contract. As such they are not handled explicitly in the convention-in it they are only forseen as an option of two clients bargaining over it. Obligation of paying the price is very meticulously described in the CISG, because it is discussed in no less than six articles. So the CISG regulates the problematic content of the obligation of paying as such and it also goes into great details about it in the 54th article. Next, the case is given to a further examination in the case of undefined or undetermined prices. This is regulated in the 55th article. The 57th CISG article addresses the place of payment for the purchase and the 58th Article deals with the time of payment for the purchase. The 59th Article resolves the dilemma about the demands of paying the price and states that the demands of paying are not a condition for arrival of the goods. The take over of the delivery is regulated in only one article. The same article articulates this obligation more specifically. Seller`s Legal means are regulated in the Articles between 61and 65 of the CISG. In the 61st article are enumerated the legal means of the seller. By reading this regulation one may get an impression that the usage of the means is possible no matter the sort of violation, but the 64th article contains special arrangements for the violations of the obligations of payment or the violation of taking over the goods. Last but not least, the 65th article handles a specific legal means of selling with specification.
