Abstract
V diplomski nalogi sem predstavila odpoved pogodbe o zaposlitvi v primeru stečaja, likvidacije in prisilne poravnave po veljavni zakonodaji v Sloveniji. Omenila sem tudi prejšnjo ureditev in napisala nekaj primerov sodne prakse. Prav tako sem predstavila pravice delavcev pri tem načinu prenehanja pogodbe o zaposlitvi. Na koncu pa sem še primerjala ureditev s sosednjo Avstrijo.
Diplomska naloga je razdeljena na sedem poglavji. V prvem poglavju je kratek uvod. V drugem poglavju sledi opis pogodbe o zaposlitvi in pravni viri, ki urejajo prenehanje pogodbe o zaposlitvi. V tretjem poglavju je podrobneje opisano prenehanje pogodbe o zaposlitvi zaradi prenehanja delodajalca in prisilne poravnave. V tem primeru prenehanja pogodbe o zaposlitvi veljajo namreč nekatere posebnosti, ki jih ni pri drugih načinih prenehanja. V tem tretjem poglavju so tudi navedene splošne značilnosti o stečaju, prisilni poravnavi in sodni likvidaciji in opisan je sam postopek. Tretje poglavje se bo zaključilo s prejšnjo ureditvijo.
V svoji diplomski nalogi sem se tudi posvetila vprašanju kakšne pravice ima delavec pri tem načinu prenehanja pogodbe o zaposlitvi. Delavci imajo pravico do odpravnine, odpovednega roka in lahko uveljavljajo pravice iz preživninskega sklada, pravice za primer brezposelnosti, pravice po Zakonu o socialni varnosti. V četrtem poglavju sem navedla tudi kakšne terjatve imajo delavci in kako se njihove terjatve obravnavajo v primeru stečaja, likvidacije in prisilne poravnave. Zadnje poglavje je namenjeno opisu avstrijske ureditve. Tudi v tem petem poglavju sem najprej opisala vse načine prenehanja pogodbe o zaposlitvi. Seveda je v posebnem poglavju opisan način prenehanja zaradi začetka stečaja, likvidacije in prisilne poravnave. Opisala sem tudi stečaj, likvidacijo in prisilno poravnavo v Avstriji in na koncu opisala pravico do odpravnine.

In this dissertation I present redundancy in case of bankruptcy, liquidation and forced settlement proceedings in accordance to applicable laws in Slovenia.
I have mentioned the previous legislation and added some examples of the case law; presented the workers' rights in redundancy of this case and at the end, I add comparison between applicable laws in Slovenia and Austria.
This dissertation is divided in seven chapters. The first chapter has a brief introduction. In the second chapter, there is a description of the contract of employment and regulatory resources governing termination of contract of employment. The third chapter gives more detailed explanation of termination of contract of employment as a winding-up of a corporate employer and forced settlement.
In this case, there are some exceptions that are not present with other proceedings. In the third chapter, there is also given general data and proceeding details about bankruptcy, forced settlement and judicial liquidation. The chapter ends with the explanation of the former applicable laws in Slovenia.
In my dissertation, I examined the subject matter as to what kind of rights the worker is entitled upon the termination of the contract. He/she is given the right to a redundancy payment due to the termination of the contract of employment, the notice period, the maintenance fund, the rights upon unemployment and the rights upon the Social Welfare Act. In the fourth chapter, I determined possible workers’ claims and how these claims are dealt with in cases of bankruptcy, liquidation and forced settlement. The last chapter of the dissertation is dedicated to description of Austrian applicable laws. This chapter also gives detailed information of all the possibilities of termination of the contract. In a separate chapter, a detailed description about the dissolution of the merger for bankruptcy, liquidation of forced settlement is discussed. I also described the bankruptcy, liquidation and forced settlement in Austria and their eligibility for redundancy payment due to termination of the contract of employment. |
