Secondary abstract: | With an increased flexibility in employment and new ways of performing work individuals tend to employ themselves on other grounds than on a classic contract of employment. We are facing a problem of an appropriate determination of an employment relationship which will suffice the needs of the modern ways of working, as well as its distinction from other contractual relationships. The definition of an employment relationship in Slovene legislation provides us with the key elements of an employment relationship. The MOD Employment Relationship Recommendation no. 198 encourages member countries to eliminate the gap between the legal determination of an employment relationship and its practical forms. When distinguishing between different statutes there are the main two groups of indicator – organizational and economic. On the basic of the freedom of movement for workers the EU Court developed its own European definition of a worker. Some European countries have somewhat defined and regulated the concept of economically dependent work. It represents a situation when a self-employed or a contract worker obtains the majority of the income solely from one client. Since there is no third option between self-employment and subordinate employment, countries have formed new solutions for the “the grey area” and have provided the minimum rights also in unclear or border situations where the true nature of a relationship is difficult to determine. |
