Abstract

Avtorica v prispevku obravnava nekatera vprašanja v zvezi z Uredbo Sveta (ES) št. 1206/2001 o medsebojnem sodelovanju sodišč držav članic pri pridobivanju dokazov v civilnih in gospodarskih zadevah, ki se dotikajo področja njene uporabe z vidika rationae materiae, v povezavi z domačim civilnim procesnim pravom. Pojem pridobivanja dokazov, ki ga je treba razlagati evroavtonomno, se nanaša na vsak sodni ukrep z namenom pridobivanja podatkov, ki sodniku pomaga, da si ustvari prepričanje o pravno relevantnih dejstvih. V zvezi z določbo, da se zaprosilo lahko nanaša tudi na dokaz, ki je namenjen uporabi v predvidenem sodnem postopku, je bolj prepričljivo stališče, da področje uporabe uredbe ne obsega postopkov, ki so z vidika samega pridobivanja dokazov šele informativne narave. Kadar gre za čezmejno pridobivanje dokazov, mora sodišče odločitev o tem, kako bo pridobilo dokaze, sprejeti na podlagi skrbne presoje vseh okoliščin primera. Omenjena uredba se ne nanaša na ekstrateritorialne pozive za predložitev dokazov in ne velja načelo njene ekskluzivnosti, zato je treba odgovor, ali je njihova uporaba dovoljena ali ne, iskati v domačem pravu.

Secondary abstract: The author discusses some questions on the Regulation (EC) No 1206/2001 on cooperation between the courts of the Member States in the taking of evidence in civil or commercial matters, within the field of ratione materiae, in connection with domestic civil procedure law. The concept of taking evidence, which should be interpreted euro-autonomous, is referring to any judicial action whose intent is to obtain information that helps the judge to convince himself of legally relevant facts. In regard to the decision, that the request can also refer to evidence, which is used within a regulated judicial procedure, is a more persuasive position, that the regulation does not cover procedures that are in means of taking evidence only of informational nature. When it comes to cross-border taking of evidence, the court must decide how to obtain evidence on the basis of a careful assessment of all the circumstances of the case. The Regulation does not apply to extraterritorial calls for presentation of evidence and nor does apply the principle of its exclusivity, therefore it is necessary to seek the answer, whether their use is allowed or not, in national law.
