Abstract
Kljub vse večji raznolikosti družbe ljudje še vedno težko sprejemamo tiste, ki so drugačni od nas. Večina nas pozna samo biološki in družbeni spol. Vse, kar ni v skladu s splošnim prepričanjem, enostavno zavračamo.
V diplomskem delu je podrobneje predstavljena problematika spremembe spola starša v Sloveniji in Veliki Britaniji s poudarkom na pravicah in dolžnostih pravnega priznanja očetovstva in materinstva s strani oseb, ki so spremenile spol. Slovenija ima za razliko od Velike Britanije zakonsko zelo pomanjkljivo ureditev, saj se na spremembo spola navezuje zgolj 37. člen Zakona o matičnem registru. Velika Britanija pa je konkretno zakonsko uredila področje spremembe spola leta 2004 s sprejetjem Zakona o priznavanju spola – Gender Recognition Act, ki določa merila in postopek za pravno priznanje spola. Pot do sprejetja GRA je trajala več desetletij, kar med drugim kažejo pomembnejše odločitve ESČP, predstavljene v diplomskem delu.
V diplomskem delu je s primerjalnopravnega vidika Slovenije in Velike Britanije predstavljena zakonska ureditev Malte, ki sodi med vodilne države v varovanju in spoštovanju pravic transseksualcev, in sicer takoj za Argentino, zaenkrat vodilno državo na tem področju.
V zadnjem poglavju je podrobneje predstavljena Konvencija o otrokovih pravicah in kako se otrok sooča s spremembo spola starša, predstavljeni pa so tudi dejavniki, povezani z odraščanjem ob takšnih starših.

Despite the growing diversity of society, people still find it hard to accept those who are different. Most of us know only biological and social gender. We simply reject everything that is contrary to the popular belief.
The diploma work presents the issue of a gender change of the parent in Slovenia and Great Britain. The emphasis is on the rights and duties of legal recognition of paternity and maternity by persons who have changed their gender. Unlike Great Britain, Slovenia has very inadequate regulation, since only article 37 of the Civil Register Act is related to the change of gender. Great Britain has, however, specifically regulated the field of gender change in 2004 by adopting the Gender Recognition Act, which sets out the criteria and procedure for the legal recognition of gender. The path to the passing of the GRA lasted for several decades, which is shown by important decisions of the ECtHR presented in the diploma work.
Malta is among the leading countries in the protection and respect of the rights of transsexuals, immediately after Argentina, which is currently the leading country in this field. The legal regulation of Malta is presented from the comparative legal point of view of Slovenia and Great Britain.
The last chapter presents the Convention on the Rights of the Child and how the child faces a gender change of the parents. It also presents the factors connected to growing up with such parents. |
