Povzetek
V diplomskem delu je obravnavana tematika pomena transspolnosti ter sorodni pojmi, ki so povezani s samo transspolnostjo. Naša družba namreč prikazuje spol v moški in ženski različici, to bi bilo naj neko naravno in ultimativno dejstvo. Posledica tega je, da so transspolne osebe podvržene veliki stopnji diskriminacije, nestrpnosti in nasilja, kršene so njihove temeljne pravice (pravica do fizične integritete, pravica do zdravja).
Osrednja tema moje diplomske naloge je raziskati razlike med pravnim priznanjem transspolnosti na slovenskem in nemškem področju, oziroma ali je pravica do spremembe spola v izbranih državah priznana ter kakšen je postopek, ki pripelje do tega, da je osebi priznan tretji spol. V Sloveniji namreč nimamo ustreznega zakona, ki bi podrobneje urejal spremembo spola. Sprememba spola v Sloveniji je urejena v 37. členu Zakona o matičnem registru. V diplomski nalogi obravnavam tudi Zakon o osebnem imenu in Zakon o centralnem registru prebivalstva, ki sta prav tako pomembna na področju transspolnosti. Medtem ko sprememba spola v Sloveniji ni ustrezno urejena, je v Nemčiji urejena v za to posebnem zakonu, ki se imenuje Zakon o spremembi imena in določanje spola v posebnih primerih- Transsexuellengesetz. Nemčija je med drugim staršem omogočila, da ob registraciji otroka ne navedejo njegovega spola.
Proti koncu diplomske naloge sem se dotaknila tudi sodbe ESČP v zadevi Van Kück proti Nemčiji, Application no. 35968/97, junij 2003.

The topic of the graduation thesis deals with the importance of transgenderism and contents related to transgenderism itself. Our society shows gender only in women's and men's versions, which is seen as a natural and ultimate fact. As a result, transgender persons are subject to a high level of discrimination, intolerance, violence and violation of their fundamental rights (right to physical integrity and health).
The main topic of my graduation thesis is to investigate the differences between legal recognition of transgenderism in the Slovenian and German regions, whether the righ to change gender in selected countries is recognized and what is the process leading to the recognition of a third sex. In Slovenia we do not have an appropriate law that would regulate gender change in more detail. The change in gender in Slovenia is regulated in Article 37 of the Home Registry Act. In my graduation thesis I also consider the Personal Identity Act and the Central Population Register Act, whic are also important in the area of transgenderism. Gender change in Slovenia is not properly regulated but in Germany it is governed by a special law called the Change of Name and Gender Identification Act in special cases- Transsexuellengesetz. Germany also allow parents to not mention their gender when registering a child.
Towards the end of the graduation thesis I also dealt with the judgment of the EctHR in Van Kück v. Germany, Application no. 35968/97, June 2003. |
