Abstract

Diplomsko delo obravnava prekarnodeloin pravicedo stavke. Namendiplomske naloge je ugotoviti, kakšne somožnostiuresničevanja pravice do stavke prekarnih delavcev.V zadnjih nekaj letih, predvsem po gospodarski krizi leta 2008, je številozaposlenih za nedoločen čas močno upadlo, na trgu dela pa so se množično začelepojavljati atipične oblike dela, kot so:zaposlitve za določen čas, zaposlitve s krajšim delovnim časom in agencijsko delo, razširilo pa se je tudi opravljanje dela na podlagi pogodb civilnega prava. Vsem navedenim oblikam dela oz. zaposlitev je skupno, da imajo določene elemente prekarnosti, s katerimi se seznanimo skozi samo diplomsko delo. Skozi diplomsko nalogo nas vodi raziskovalno vprašanje, kako je v Republiki Sloveniji urejena možnost uresničevanja pravice do stavke prekarnih delavcev. Raziskovalno vprašanje najprej razčlenimo, nato pa skozi posamezna poglavja, predvsem s pomočjo opisne oziroma deskriptivne metode,poskušamo odgovoriti na raziskovalno vprašanje.Položaj prekarnih delavcev urejajo različni zakoni.Možnost uresničevanja pravice do stavke določajo že nekateri mednarodni in evropski akti, Ustava Republike Slovenije, podrobneje pa jo opredeljuje Zakon o stavki, ki izhaja še iz Socialistične federativne republike Jugoslavije.Stavka je velikokrat edino sredstvo za zavarovanje pravic in interesov delavcev. Kljub temu, da je položaj prekarnih delavcev zakonsko urejen in da si država prizadeva zaščititi pravni položaj vseh delavcev, slovenska zakonodaja dopušča, da je za določene kategorije delavcev možnost uresničevanja pravice do stavke omejena.Zaradi pomanjkljive zakonske ureditve na območju Slovenije, so nekateri prekarni delavci prikrajšani do uporabe instituta stavke.

Secondary abstract: This thesis will address the precariat workforce and their right to go on a work strike. The purpose of the thesis is to determine to what degree can the precariat workers exercise their right to go on strike. In the past few years though, following the economic crisis of 2008, the number of permanent employment experienced a drastic downturn. At the same time, more atypical job offers started to dominate the job market, such as fixed-term contracts, part-time employment, temporary agency job offers and civil law contracts. All of the aforementioned work arrangements fall into the category of precariat jobs. The term precariat comes from merging 'precarious' with 'proletariat'. All the aforementioned work arrangement has in common certain elements of precariat. We will get to know them through thesis itself. The research question of the thesis was: how is regulated the possibility of exercising the right to strike in Republic of Slovenia. Firstly we dissected the research question and then, through individual chapters, we tried to answer the research question, mostly through a descriptive method. The position of precarious workers in Republic of Slovenia is regulated in many different laws. The Slovenian constitution and some international and european regulations entitles the workers to go on a strike, and this right is further explained by the Law about work strikes. Aforementioned law was published in Socialist Federal Republic of Yugoslavia. A work strike can sometimes be the only means for workers to defend their rights and interests. Despite the fact that the position of precariat workforce is regulated by laws and the goverment wishes to protect the rights of its working force, but at the same time, it allows the right to strike to be limited to some of its workers. Because of insufficient regulation by law, some of precarious workers can not exercise their right to go on strike.
