Abstract

V primerjavi z drugimi državami je naša zakonodaja za preprečevanje mučenja in zanemarjanja živali v nekaterih pogledih pomanjkljiva, sankcioniranje kršiteljev je preblago in na njih nima ustrahovalnega učinka. Za uresničevanje pravnega varstva je potreben uradni nadzor nad spoštovanjem in izvrševanjem zakonodaje. Odvisno pa je tudi od naših dejanj, kako bodo živali zaščitene pred našimi dejanji oziroma kako se bodo živali počutile v naši bližini. Zgodovinska metoda je bila uporabljena za pregled zgodovinskega varstva živali in zakonodaje. Z deskriptivno metodo je opisano trenutno stanje zakonodaje varstva živali v Sloveniji. Komparativna metoda je bila uporabljena za primerjanje ugotovljenih dejstev različnih avtorjev ter primerjanje slovenske zakonodaje z zakonodajo drugih držav. Uporabljena je bila tudi metoda kompilacije za uporabo izpiskov, citatov oz. navedbe drugih avtorjev. Metoda spraševanja je bila uporabljena za mnenje ljudi s pomočjo anketnega vprašalnika, objavljenega na svetovnem spletu. V okviru anketnega vprašalnika je bilo ugotovoljeno, da je večini anketiranim osebam mar za dobro počutje živali, da so zaščitene z zakonodajo, da se jih zavaruje pred mučenjem oziroma zanemarjanjem in da kršitelji, ki neprimerno ravnajo z živaljo zato tudi odgovarjajo. V primerjavi z drugimi državami in na podlagi mnenja anketiranih oseb bi morali Zakon o zaščiti živali temeljito preučiti in spremeniti. Izsledke diplomske naloge bi lahko uporabili kot predloge za spremembo zakona, ki so nujno potrebni za varstvo živali, saj trenutno naša zakonodaja bolj ščiti kršitelje kot živali. Prav tako stremimo k temu, da bi imela policija in društva za zaščito živali več pristojnosti za ukrepanje na področju varstva živali.

Secondary title: Protection of animals by competent institutions
Secondary abstract: In comparison of Slovenia to other countries, the legislation is not strict enough regarding the penalties for the lawbreakers. Thus, no effect on the prevention of animal neglect and torture is achieved. State organs, such as veterinary inspectors and police have certain jurisdictions and procedures and are responsible for law enforcement. On the other hand, it is also our responsibility to look after the animals welfare. Furthermore, the history of the legislation for animal welfare was reviewed, the current legislation for animal welfare in Slovenia was described and slovenian legislation was compared to other countries. For this we compiled notes, quotes and statemensts of other authors using secondary source of collecting data. In addition, people were questioned for their opinion using a questionary published on the world web. It was found that most interviewe are interested with the protection of animal welfare with the legislation. Furthermore, that the people who breake those laws are found guilty and appropriate punished. In conclusion, based on the comparison to other countries and the opinion of questioned people the laws in Slovenia for the protection of animals shoud be thoroughly studied and adjusted. Findings of this graduation thesis could be used to support the changes, which are necessary for animal protection, with regards to the fact that the current legislation is more inclined to protect the offender than the animal affected. We also strive for greater jurisdiction of the police and societies for animal protection.
