Abstract

Diplomska naloga z naslovom Pravna ureditev predznamb s poudarkom na sodni praksi, poudarja pomembnost instrumenta predznambe v pravnem prometu z nepremičninami in prenosu lastninske pravice.Predznamba je namenjena vpisovanju pogojne pridobitve oziroma prenehanja pravice. Zaradi te lastnosti se bistveno razlikuje od drugih instrumentov glavnega vpisa, to sta vknjižba, ki služi vpisovanju nepogojne pridobitve oziroma prenehanja pravice in zaznamba, s pomočjo katere se v zemljiško knjigo vpisujejo pravna dejstva.

Secondary abstract: The Thesis entitled The legal regulation of the preliminary note with the emphasis on the case law, emphasizes the importance of the preliminary note in legal transactions with real estates and ownership transfer. Preliminary note is used to enter conditional acquisition or termination of rights. Because of these characteristics is significantly different from other instruments of the main entry, as entry wich is intended to enter unconditional acquisition or termination of rights and note, through wich legal facts are entered in the land register.
